I think Dan has moved past "bad guy" status. He has apparently taken the leap to two bit con-man.

he just keeps digging himself deeper and deeper with his poor business ethic, attitude, childishness, and this mis-understanding of being a true Godly person....
I don't think Ryan will ever see the money he is owed and I think Dan will continue his downward spiral....

I would certainly bet that Ryan will not see a dime of the money he is rightly owed. It is my belief that Dan made his first mistake with Ryan when he first refused to pay what Ryan was rightfully owed. His next, and most disastrous mistake was the way he acted when confronted about the situation, as well as the way he presented himself when the issue was brought to the BOI. In my opinion, Dan may have been able to save his name if he handled this thread with maturity and heeded the advice given to him by many. Instead, he chose to act in the worse way possible and destroyed his reputation with his childish and ignorant conduct. Things only got worse as time went on and Dan rightfully earned his new-found "bad guy" status.

From that point, I feel that Dan knew how badly he'd hurt his name and his chances of succeeding in this business. Therefore, it doesn't surprise me that he seems to have stopped trying, as evidenced first by the group of thin geckos he offered on classified ads, and then Reptile Auction. I think he is giving up, or running away from this problem to find a new place to eventually continue to scam people (fish business.)

Therefore, it doesn't surprise me at all that two more people have come here with their problems regarding business with Dan. It seems to me that at this point, he cares nothing about satisfying customers, or receiving good feedback. In other words, he's already passed the point of no return and hopefully we'll see less and less of him as time goes on. My concern is for his geckos as well as the last few people he continues to scam. I can only hope all of his remaining geckos find good homes, and that well-intentioned people do not lose any money through the whole ordeal. What happened to Ryan is bad enough.

I also have had it with his comments through both here and email. Particularly, his calling others "childish" is a joke. I'm also quite disgusted with his use of God in nearly all of his rebuttals. I suppose the only thing we can do is hope that someday, somehow he learns a lesson from all of this...

Umm, well, I don't think I will see the leo I bought from him.... It was supposed to go out today, but I haven't heard a word from him since last week. That sucks, because I was hoping I'd get it for my birthday tomorrow... I guess I can't say for sure until tomorrow, but it looks like I'm going to be out $95.

At this point I'm going to have to agree that he has become a two-bit conman. I don't usually post just to jump on the band wagon but I think it's time.

I enquired about a gecko on December 14, 2005. I received a positive reply and and I ask for the bottom line the next day.

Dan replied "Just send the money and if it is okay weather wise, I will ship him." The gecko was listed for $65.00 I knew that there would be shipping but I sent the $65.00 via Paypal to his email address on December 15. His reply to me was that he did not have a credit card and could not receive Paypal payments so I canceled the payment and sent a cashiers check the next day for $65.00, he never said anything about shipping. (I should have realized something was up then)

On December 19th he emailed me and said that he had received the $65.00 but there was a $40.00 shipping charge and he offered to return the check. I told him I would forward the $40.00 the next day and I did.

On 1/4/06 I emailed him and ask if he had received the shipping payment. he replied that he had not. I payed to cancel the cashiers check and have a second one issued. The second check was mailed on Monday 1/9/06.

On 1/26/06 I emailed him and ask about shipping the gecko and he replied that he had not received the shipping payment. I ask if he had cashed the first check and if the gecko was still available and he said he had cashed the check and yes the gecko was available

On 2/21/06, 68 days after I paid for the gecko I received the second check returned marked "Unable To Deliver" The address is correct, everything was correct. I ask for a refund of my $65.00. His reply was that he had never received shipping money. I responded with yes I have sent shipping money twice and I can fax you a copy of the envelope and check to prove it.

On 2/22/06 I offered to forfit $10.00 for postage and handling if he would return the now $55.00 left. After two more emails on 2/22 and 2/23 I received this:

(DAN)you act like I'm scamming you or something, i never got the shipping money, that is not my fault, so stop that petty BS i'm broke right now, you'll get your money back when i have it

On 2/28/06 I emailed Dan and ask that he send a picture of the gecko on today's news paper to prove that he still had it and that I would resent the shipping money via a postal money order so if he didn't deliver it could be taken as mail fraud.

First he said he would send a picture in a "few hours" Two days later after I threatened to post on Fauna he replied with this reply on 3/1/06 "i'll be sending your money back when i have it"

I don't think I'll ever get the money. I apologize for the long post.

I've been only waiting since Feb 1st. He was quick to cash the checks though, which he should only have done before he was prepared to ship the gecko. Had I known he wasn't going to ship I would've stopped payment on my checks. So, what, are we all going to have to wait for whenever he gets money for us to get our money back??? When will that be???
$95 isn't a lot of money to most people, but I'm a full time student and single mom that is just getting by. Every year I get a new animal with my tax refund, this year I had decided to go with classified ads instead shelling out $200-500 on one animal and ended up getting two. Both of my first Fauna classifieds experiences have gone horribly wrong now, and I probably will stick to high end breeders from now on. I'm out $95 on a gecko that never arrived, and I paid $108 for a skink with $125 additional vet bills because it came sickly. I could have gotten a healthy baby skink for half that price elsewhere.
I'm just a little upset about all of this, and it's really unfair.

Jeeze....The money should never be spent till the gecko has arrived Happy and healthy at it's new home.
Cashing the check is OK but spending it and not having money for a refund is wrong. All this BS I'm broke and I'll send it when I have it, thats just lame.

I hope you guys do get your money back And Kate don't be turned off to everyone, my first two experiences were not great and also turned me off from unknowns but there are alot of great people here , many more good then bad, most of the time you can tell who is good and who isn't. Dan just seemed to be able to pretend to be something he wasn't and fooled some people.

I finally got a response by Dan. It was only after I told him that I would contact the Internet Fraud Commission, which I've had to do one other time for something Ebay related, and I would do it again if I need to.

The emails pretty much speak for themselves.
This is what I sent him this evening after sending a few emails throughout the week to see if he was going to send the leo.

Ok, so it seems obvious that I will not be getting the leo since there are other people that you haven't sent their leos to either. If I don't receive either the leo or a refund of $95 (either by paypal to [email protected], or a tracking number as a confirmation that refund has been sent via mail), I'm going to report this to the Internet Fraud Commission. I just don't give out my hard earned money to people I don't even know so that they can just give it back whenever they feel like it. This is not a threat, it is the only way I see fit as to getting my money back.

You couldn't at least inform me over the weekend you weren't sending him out today? I can't take off from work or school again for this. As far as the weather conditions, there have been many times where you could have sent him out, you just didn't. There is an entire thread on Fauna about people not getting leos from you that I didn't see until after the 3rd time he was supposed to go out. I'm not a rich person and I'm a single mom. I work practically 12 hrs a day just to make ends meet, and I do not appreciate you being so quick to cash my checks and then stringing me along for a month. I bought a leo from The Urban Gecko this exact same time last year, and they drove through a blizzard to meet my fiance at the US border, so I really don't buy your excuses.

the check was cashed 3 days after it was recieved, it was cashed quick
because i thought the gecko would go out quick

I added that thing about The Urban Gecko not to suggest he should drive in a blizzard, but to show that people should care about their customers enough to put forth a little effort. All I did was look on the classifieds and saw a leo that I wanted to buy. I paid in full for it, and waited around for a month being told every week or so it would go out. I took days off, and it didn't show. That is money I could have earned and classes I should've been in. I don't understand why he's being so rude to me. This is unreal.

You know, I've been hesitant to post about all of these new ordeals regarding Dan, but goodness!

Dan just seemed to be able to pretend to be something he wasn't and fooled some people.

I 100% agree with this comment, I've said it before, he puts up a great facade. He's really good at coming off somewhat professional, but once he backs himself into a corner he's is quick to loose his temper, point the blame on everyone else but himself, and now come up with endless excuses. I bit my tongue about what happened between he and I, but I'm really glad Dan was exposed who he really is. It might not have come about the best way possible, but if you've read this far I'm really glad you did.

I really having nothing left to say other than I'm shaking my head. Also, I'm really sorry to everyone else that has fallen into the bad guy wormhole that is Dan.

Just to clarify, the shipping money was sent twice. I never received any reply from the first one I sent but I have the receipt I got where it cost me to cancel the certified check. The second payment I got back via the post office marked "Unable To Deliver" with the correct address. I re-deposited the funds back into my account but I have the returned envelope. I offered to fax these to Dan with no responce.

So at what point can the police become involved in this? He is ripping people off. If more then one person were to contact the local police in his area it would put a stop to this....It is what I, and others had to do with a creep named Mike Roe that ripped me and others off. I did finally get my money back after the police paid him a visit......if you still have no money or gecko, I'd say waiting is a waste of time as he has proven himself to be lower then dirt con man.....

Yes, I actually did just get my refund, after spending weeks being frustrated and being treated extremely rudely by him. Boo hoo if it set him back. Doesn't he still live at home with his mom? The way I see it is that right now, he's using peoples' money like it rightfully belongs to him, like using it as a loan that he can pay back whenever he feels like it. Anyone who is in business knows you can't do that. I guess he missed morality 101.

Well it has been 113 days now with still no gecko or refund. All I can say now is if I don't get my refund by next Friday April 14 (120 days / 4 months since this all started) Dan can expect the Sheriff to deliver a summons for court. I've had enough.
