    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Let Me Clarify

When I first checked this thread there was only one post from Ritchie Luna. I started typing something, walked away for awhile, and continued on unaware there was a lot more information posted. If the package was left alone with no one present to receive it then that would completely void any warranty on Neil's part since vitually anything can happen in that scenario. Right now I'm not sure what proof the buyer has that he was or wasn't there, why was the package delivered to the home rather than held at the facility? Also where does the buyer get off saying coke can sized, etc.? Even if one was that size does anyone actually think it would breed? I'm going to wait for more input before saying more. Right now it's pretty sketchy.
 
Playing Devil’s advocate here Neil.

If there are two packages on that air bill, how do we know that the one you sent him was not one pound?

Second, if Ups delivered to the wrong place and you can prove that it was suppose to be held at UPS I think its there fault period.
 
I have to admit I'm not too keen on the whole "this happened to my buddy" posting. Neil brings forth proof and suddenly the poster isn't responding?? I really think posting a title like the one heading this thread with NO foundation should be grounds for a fine, suspension or something. It just strikes me as a bit of a crock!
 
If the buyer did not agree to except them at his house, why would it be his fault?
It would fall on the shipper and the shipping company, would it not?
 
Dennis.... if you look at the airbill I posted, it clearly has the 3.9 weight with Brian's name directly to the right??.... How much clearer do you want it??.... That paper is MY UPS BILL.... I was BILLED for TWO packages.... the one that went to Fredericks, and the one that went to Brian.... what else can I say??
 
Confusing and sketchy indeed.

Since Neil sent it "Hold at office for customer pick up" and it got sent to the customers home anyway I would say that the shipper is more at fault than anyone.

So if it was me I would refund the customers money and file what ever claim needed filed with UPS to recoup my money. Now if you were not authorized to ship snakes through UPS and that is not an option, then it is your own fault for using them knowing their policy. You should just take a loss on this one if that is the case. I know for me personally that if the shipper screwed up and my customer did not get their snakes due to no fault of their own that I would give them their money back or replace the snakes.

Of course if you think the guy is lying about not receiving the snakes I would hold off on the refund pending further investigation.
 
Also Neil,

You can always scan the airbill in sections and post it so we can see the whole thing. Just like you did with the section you posted already. Just do the rest.
 
Sammy.... then YOU pay him.... I'm done with this liar and "potential" thief!!....

Had he come to me on the 14th saying that he got the box and it was emptyand was there anything I could do about it (and left it at that).... I would have probably (at worst) got him another pair at HALF MY COST, so I'd at least have split the loss.... but when he starts off by telling me that I shipped him an empty box and that I stole his snakes.... he can take a flying leap!!....

I'm done with this thread.... ALL your questions have been answered to the best of my ability WITH THE PROOF.... if you have any more questions, just RE-READ the thread and you'll probably find the answer to them....

If it was my deal I would..... if I thought he telling the truth about not getting his snakes.

Again, can you post the entire air bill in sections? Like you did the small section you already posted. Just post the rest in sections. That way we can see the whole thing and it would help clear up any confusion.

I agree on this one. I don't like those TOS that state that they guarantee live delivery, except in the event of shipper problems. When you use a certain shipper you are hiring them as your agent to deliver a product that should not be the responsibility of the buyer until said buyer accepts the shipment. If it was marked "hold" it should have been held. That makes it the fault of the shipper, even if someone stole the snakes off the front porch. The breeder should be even more culpable if they are shipping "illegally" or "under the radar". Neil, do you have a contract to ship LIVE SNAKES via UPS? Or are you doing it "under the table".
 
As you can see.... the FIRST package to Tom was for 1.1 Adult Emmy's.... it says 1 pound on top and the actual weight of 15 pounds beneath it.... the second package is the one to Brian.... it says 1 pound on top, and the actual weight of 3.9 pounds beneath it.... does that make it clearer??

I am not attacking you Neil in any way and I am not a member of the Neil Sucks Club. So please do not take my questions as attacks, they are just for clarification purposes. If Brian was here he would be getting some thrown his way as well.

Seems to me that this is going to be a judgment call on the seller, he can decide to either refund, or if he feels he is getting his chain yanked than not refund.

So far I haven't seen anything from the actual buyer proving that the seller sent an empty box, on the contrary the seller has shown proof that the box wasn't empty.

Anyone that ships regularly through UPS knows snakes are not allowed. If shipper and receiver both agreed to use UPS, they are both at fault, since UPS won't do squat.

Then there is the problem of the box being left unattended on the porch. UPS screwed that up, but it was already said that they won't take responsibility, so it is up to the seller to decide, if he has a "Live Arrival guarantee, to honor the guarantee or not.

I fail to understand the logic in being sent to wrong place.
Neil, if we are doing a lot of business together and you have my home address and my work address. We agree to ship to my work address and the package is shipped to my home. How would it be my fault?
