    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

NY reptile ban has been signed into law!

Dan you posted while I was posting. If you read the full report on salmonella by the CDC they still can not verifiably state that it is directly attributed to a reptile as the cause.

I keep reptiles and have had Salmonella. So technically its my reptiles fault even though 30 other people who ate at the well know fried chicken restraunt got it too:)

The CDC does not go to every medical illness 74,000 salmonella ya there budget wouldnt allow for it. Even they state ESTIMATE. If you live in south Florida right now you would love ESTIMATED Electric bills you know 1000$ for 38 days and you didnt have power for 16 of them.

So again show me hard cold facts would be how to fight this speculative scare tactics. Unless the Herp Keepers and Societies in NY ban togeather and fight it your SOL. Sorry to see it happen when there is obviously enough for the Herpers to use for grounds as a repeal or at minimum a revision.

Absolutely! And that's why they say directly or indirectly, just to cover their...

Besides, even if the 5% were true, it's a ridiculous figure, considering that the other 95% comes from food contamination alone.

If left to the NYers alone I don't see there's much they can do. This has to be a movilization at the country level. They might have started by NY, but if they see no resistance at all, you can bet they will go for other states.

A person even with an issued permit cannot breed, sell, etc. a reptile in NY state. Right?

Here is the question.

If after receiving payment (postal MO, check, etc.) in NY someone ships a reptile to let's say CA, where did the transaction (action of selling) actually took place? NY or CA?

Thats a technicality the Gov. is still working on.

As i understand it , internet sales don't really happen anywhere and its driving some lawmakers into fits. About the only laws in internet sales are state taxes for buyers in that sellers state and fraud. The internet is a " nowhere " place in reallity. If I'm wrong feel free to correct me since I'm just a silly a$$ redneck.

In reality I don't believe in right or wrong answers, just different approaches to an issue. Maybe lawyers are having a fit with the internet. Now, if you sell reptiles in NY (to be shipped to CT) in which of the two states are you going to pay sale taxes at the end of the year? You order a heat pad from Apple Herpetological. Was that item sold in NY? Does AE have to declare it at the end of the year?

That's where you misunderstood my post. It cannot be sold within the state of New Yorlk, I absosultely agree with you on that one. Now, if you have a snake in NY (with possesion permit and everything), can you receive money in NY and ship it to CT? MY "legal" question is are you thus selling the snake in NY or CT? (the question I need someone to answer is the last one in bold). The only way I see you could possibly legally sell a snake owned in NY is if you personally drove her out of the state to be sold elsewhere. Do you get my point? Now, I believe the issue of illegal shipping practices and how they threaten our industry is far more important.

Did you recognize the sentence I quoted in Kevin's thread? That one is appropriate for that thread as we are discussing the legality of shipping practices. Looking forward to your input in that thread in the BOI.

The question on importers is answered right there in the text, and it's clear. You will not be allowed to import them in the state, period. It doesn't matter to the legislators if that's your source of income. That's why I feel it's important to do something about this. If we stay puy this is not going to stop in NY.

Ok I see what you are getting at...... Technicaly the transaction took place in NY, but, the animal will not be in NY when the transaction in complete...... And that is all the law makers care about...... And a person can not legaly make a buisiness by selling venomous out of NY because once the spacific animals on the permit are gone they can not be replaced And you no longer have the permit...... Also you would have to let NYSF&G know about any animals you do not have in your possesion anymore.....

That's exactly my point. You have to keep the animal for all his life unless you sell him out of NY. If you sell it in NY (by receiving a wire, money order, etc.) and then ship it out of NY you would be breaking the law.

So, whats going on with this? I just went to the last WhitePlains show and could sware I saw burms, red tails, monitors, etc. Unless I am confusing it with Hamburg, where I know I saw all that and more, lol.

Anyway, so is the WhitePlains show going to wind up being colubrids, beardeds and geckos soon? Thats what happend to the Staten Island NY show when the NYC law was passed a few years ago and its gone now, nobody went to it after the law.

I also say we should look into fighting this somehow. Its just rediculous. Especially the NYC version (not State) which bans ALL Boas, Pythons, Monitors, Tegus (Tupanambids) and Iguanids because they are "Potentially Dangerous." This includes Childrens Pythons, Dwarf Monitors, Sand Boas, Fence Lizards, Lacertas, Ameivas, etc, etc. They are all really dangerous animals! I know I couldnt sleep at night knowing I had a deadly western fence lizard in my house! :rolleyes: :bandhead0

I didn't read where it said you could get Ebola from reptiles. I saw where you could get Ebola from wild animals which is a possibility although a remote one.

While I do not like the idea of the Government telling me which reptiles I can and can not keep, I do think that this is one of the more reasonable laws I have seen. It seems to limit itself to the species that cause the most problems or have the potential to cause the most problems. It seems to spell things out fairly cleary and defines the terms as not to be deliberatly vague like so many laws. I really like the laws that ban "dangerous animals" that narrows it down. It sounds like they listened to someone when they took out the Boidae group and specifically listed the species that were included.

Like I said, I do not like Government bans, and if I were a resident of New York I would not be particularlily happy about this but I would feel a bit better since it seems like they tried to be resonable.

I didn't attend the most recent white plains show, but I was at the one before. I didn't notice any of the newly banned animals. keep in mind that the bill was revised, and the law as passed is less prohibitive. RTB's are still legal, as are some monitors. I'm sure that if Bruce noticed burms, retics, rocks, amethystines, niles, ...(insert any of the other banned animals here) , he would have made sure they were immediately removed. Hamburg, on the other hand, is not bound by such foolishness - and there were big snakes aplenty. As for the law being reasonable, I happen to disagree for a number of reasons; but I live here and have witnessed the political force first hand (done battle and lost). At least it is better than it could have been.

I did read most, but not all of this thread. But I will address the main topic.

All the B.S. being spread about reptiles spreading disease, and killing children etc. is being spread by the same organization whom is putting the pressure on the politicians to pass all these ridiculous laws. It's all caused by none other than The American Humane Society, and their friends in PETA, and the SPCA. If you want to fight this kind of crap, you will have to fight these idiots. They are totally against the keeping of ALL reptiles. Period. They even have T.V. commercials that tell us this.The politicians just do what these jerks tell them. And the only way that I can see to fight them, is to organize a National Herpetological/Herpeticultural Society. Until we do that,...we don't have a snowballs chance in you know where. We need to fight back!!! This kind of garbage is happening all over the country. And the sad fact is,... most of the time it's totally unopposed. If we don't get busy, and create some opposition for those jackasses, they will continue to pass stupid laws! Just my 2cents.

There does need to be a national society or association.

I have found none in the US dedicated solely to the Herpetological community.

A key component of such an organization would have to be deep pocket sponsorship (read corporate backing) so that a full-time lobbying effort could be underwritten.

This should truely be a call to action, yet I fear that this thread will go relatively unnoticed.
