So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

you say there was a dispute when there wasnt....and that you would prove it and didnt.

Now you say its because it doesnt show because i called in? You can not call in a dispute. You have to check bo0xes. They need a paper trail.

You have not made ONE piece of evidence showing any of the BS you claim in your post. NOT ONE bit of evidence to make your claim.

I did show the time line. I showed the PM sent on the 24th you asking for pics to purchase.

I showed the email on the 26th where they pictures were sent to you.

I showed that LATER on the 26th the time you paid the paypal.

I showed it? All screen shots are there with the dates and times.what are you talking about? show what you are saying?
 
No she can't post a recipe, nor can she post a receipt. Her "refund" was the picture I originally posted.

You say I haven't provided any proof of my conviction. Nothing Wendy has said provided you anything new. I said she emailed me pics. Now she said she sent me a mysterious $100 so now I owe her this money that she supposedly sent me?

How do you sell the same chameleons to two different people. I got off the phone earlier tonight with a guy that bought the same lot of chams and sent Wendy money after she sold the chameleons to me.

You believe everything she says because she posted pics that she emailed me. You are presumptuous then unbelievably gullible.

Wendy never once mention the temps until 8 days after she was originally scheduled to ship. I'm positive that temps were not that high especially with a 10:30 delivery time. blah blah

You posted those pics online trying to sell the chams you did not have in your possion, is that correct?

Are you certain she did not have a few lots of chams for sale? it's certainly possible she still had your lot after she sold another lot to someone else.
 
To me, it was compensation for aggravation and delay, and not part of payment and product.


It doesnt matter what YOU see it as, it matters what he agreed it as. It says REFUND clearly. He agreed to that by accepting the package later.

Reptile Addiction : Is there some personal problem? Shipping is standard for everyone in the industry. I cant control tremps, why are you so hopped up about it? I do not have a refund policy. Again like most in the industry. These are all things you accepted in the TOS. I have a good reputation, I have been here for years. I have a store I am at most every day. Where do you think these guys are going to? I think you have to take a big breath and look back at these text. You say you are posting them in october for sale - Your text - what is it your not telling me?

Okay then, send my money back until you can ship. Any business that cant ship a product for any reason sends customer a refund. Thats normal business practice.

If you want to reference my TOS, please don't pick and choose passages to suit your purpose. That very same item that references the 25% nonrefundable deposit clearly states: The only time a deposit will be refunded is if I am unable to provide the animal.

He wasn't buying on a payment plan, or giving a deposit so you would hold the animals - he paid for them. The failure was at your end, as they were not shipped. That said, and acknowledging your reference to my TOS statement (Shipping may be postponed due to extreme temperature/weather conditions. I may, at my discretion, require FedEx shipments to be held for pickup or suspend overnight shipping options in favor of Delta Dash. This is for the health of the animal...thank you, in advance, for your understanding.), I feel that delays due to high temps are an understandable reality. However, I can see how a customer would get frustrated in the face of repeated delays for various reasons. Your temps were not too high to ship, and the arrival temps were not necessarily out of range - it would have been a simple matter of having the package held for pickup. Shipping would have taken place, the package would have arrived at FedEx in the early morning, and the chameleons would have been kept in a temperature controlled environment until they were picked up.

Looking at the first post of this thread, there IS a problem. The buyer was trying to get you to ship to somebody else's address - there is no statement indicating whether you agreed to, just that the package never arrived. For future reference, with PayPal payments, you lose what little protection they might offer if you ship to a different address (I have asked PayPal, and they told me that having a box held for pickup is acceptable, as ID must be shown to claim the package).

I do see Lucille's point, but I'm not sure that I agree with it. I can see offering small refund to compensate a customer for the frustration of delays....but I don't know that I agree that the customer deserves that on top of a full refund if the sale is cancelled. The mistake that was made is, again, on the seller's end; as that refund should have been issued via PayPal. It would have taken the amount off the transaction...then, when the dispute was filed, you would not have been out that extra money.
The refund is also being disputed by the buyer - he says no check arrived, you (and/or Rochelle) claim it was sent. Somebody is being dishonest. The message sent to him was that it was a postal money order. Those come with receipt stubs. Please post the receipt to help resolve this.

1. Brandon paid $1500 for some Chams

2. Brandon was unhappy with the delay in shipping due to temps and complained.

3. The seller offered and sent a $100 discount to appease the customer on the(justifiable in my opinion) delay.

4. The buyer then filed a dispute with PayPal for the full amount ($1500) and was successful and was refunded.

5. He also kept the $100 discount

6. The seller wants (and in my opinion is entitled to) the $100 over and above the purchase price returned.


Putting all feelings about Wendy's past dealings aside, if the list above is correct, Brandon owes Wendy $100 plain and simple.

No shes not. She stated earler that the whole laot had been sold again to a third party. She never said anything about wanting 1300 or wanting the deal to continue.

What I said is ::: I did not what HIS money That I would give his entire purchase price (which he got) to go away. That he wasnt worth the trouble. That to just return my $100 that was extra above the $1500.

The only thing I want is the extra $100 he received above the $1500.

ok people....everyone...for just a few seconds...pretend you have never EVER heard of Wendy Childs before...because in reality....without her past...this situation is starting to turn on the OP a little...and her past has nothing to do with that

I would have to agree that shipping in weather over 100 degrees is a BAD idea...the OP was DEMANDING it be done...I wouldn't have shipped either...now I would have refunded in full and been done with him VERY quickly....but it seemed Wendy was trying to save the sale...so she did what she thought was best....I fully understand why she would not ship in that weather

its been done yes....and animals have lived....but animals have also liquified in their boxes in heat like that

Wendy has provided a lot of evidence in this situation...nothing in the paypal dispute says she claimed she shipped...and she is correct in the fact that even if she HAD CALLED paypal and told them something, they would have made a note of it in the dispute....but I'm pretty sure they would have directed her to put that info into the dispute online, and been done with the conversation.

So...the OP says she told paypal she shipped the animals....but there is no proof...even tho the OP did state he could provide proof....Wendy has given proof...where is the OP's proof?

Personally....I would be LIVID if a customer kept $100 over what they where supposed to get refunded from me....even if they thought it was for their time and issues

I agree with this unless the OP can provide some proof of anything. I will say that I wouldn't want to deal with Brandon after reading those messages. I would never ship in temps like that. What if the package was delayed in that heat, or worse, lost? At least they would have a chance with regular temps. As long as he wasn't lied to saying "it shipped, here is your number", then Wendy was right to ask him to wait. It's a part of my tos that I won't ship if I think the temps are too hot or cold.

I really don't think that either person is going to be able to give 100% proof either way. If Brandon does have $1600, then he should refund the $100 difference. He's not out anything and should be happy to be done with it. Dragging it out just causes more drama and he said, she said.
 
Just as a statement, I don't think either side has shown that the 100.00 in question exists. OP insists he did not get it, Wendy insists he did. Pretty he-said she-said, without evidence to the contrary on either side.
