    In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

even, this is not about Rich and you and how he treated you. It is about the shoddy manner in which you treated Simply Snakes. I guess it's time someone told you yet again, You ain't the center of the universe, it's not all about you and how you feel you are slighted or picked on or ignored by others.

This particular thread, which should never have been started, as you yourself have stated, is about how you let your temper get out of control, which you have also admitted, and said things you really shouldn't have, which I also believe you admitted.

If you want to address the way others are treating you for acting like such a spoiled brat take it to the general business forum or start another thread.

You and you alone were out of line on this. You and you alone have continued to say you are done with this and then come back and complain about totally unrelated topics. Talk about wagging the dog here.

Does megalomania mean anything special to you? You have been given some sound advice here. Take a day or two off, cool out and get some perspective. You're starting to sound a lot like a spoiled 8 year old that got caught swearing and is trying to blame everything else in the world for his behavior. Heck, you aren't even addressing the behavior that started all this.

You do yourself no favors by continuing in this manner.

They took this whole thing out of the professional court. Some say that Evan shouldn't have asked for a better price. Why not? It is the sellers choice what they sell their animals for, that is their right. Well it is the buyer's right to ask for a better price. How much time did he waste of theirs? It wouldn't take a normal person more than thirty seconds to type out those one sentence responses. If they emailed him four times, then that is two minutes total. Perhaps they were annoyed with Evan asking for a better price and considered him a nuisance. Does that make it right for them to be unprofessional to him? No. People "wasting your time" and such is part of being a business. It is not an excuse for their imperative that Evan should not waste peoples' time. Evan was verbally struck, and he struck back. Since when is that wrong? How like the justice system this particular thread seems to be. A burglar breaks into your house, you shoot him, and he sues you and wins. Evan over-reacted, but it was a reaction. That means that something was the cause, and I doubt Simply Snakes being great guys was the cause.

I don't understand why the majority of this thread is attacking Evan to the point of entirely excluding Simply Snakes as far as placing blame.

Maybe someone more versed in law may want to expand on this answer, but justice means:

1 a : the maintenance or administration of what is just especially by the impartial adjustment of conflicting claims or the assignment of merited rewards or punishments

"Assignment of merited rewards or punishment" . According to the justice system, there has to be a relation between the action, and how it will be ruled. If someone steals a pie from your window and you shoot him, you are going to pay for it. Similarly, you are not going to be awarded six figures in damages if someone breaks your window by throwing a stone at it.

After 4 e-mails were exchanged Paul's reply was maybe not very professional or lack customer skills if you will. Evan's reaction was completely out of proportion. kind of slow ahead of him, would you step out of the car with a baseball bat and smash his windshield? :)

I personally don't find the manner in which Simply Snakes responded to Evan to be that awful. Does it sound like they were trying to make a new friend? No... Was their any foul language or name calling? No... I personally have always tried to respond to people as friendly as possible regardless, but I do not think this warranted a thread in anyway. So now it is allright to start calling names and going off on people because you feel you were talked down to? Aren't you still a business that is supposed to act professional at all times? They feel they were slighted by Evan for not reading the FIRM in the add. Firm means one thing to me regardless of the supposed 80% gray area. Evan felt slighted due to a quick, straight to the point response. It seems like one of those sexual harrasement cases for over hearing an episode of Seinfeld being talked about in the office. I think were being a little too sensitive here. I personally would apologize and try not to take it personally Evan. I know I have contacted Evan looking for stuff and he was always helpful and friendly.
On a side note... I do understand why Evan is getting frustrated on the second issue. It does seem as though we might be getting very close to losing our rights to keep reptiles. It is an issue that might effect everyone of us in the near future. Even if you don't want Evan to be the representative for our hobby, he is still trying to get the information out there and it would be very valuable to have this information in a heavy traffic area. Maybe one of those threads that cannot be responded to at the top of the page. With a link to contact Evan for any info, updates, or ways that someone could personally help. Just an idea.

May I ask when was he "verbally struck" thereby allowing him (as you see it) to strike back?

As I read those emails, I see it as Evan bothering someone who clearly stated in his add that he was FIRM on the price. People usually do that because they are unwilling to come down on the price. The seller also, if I remember correctly, stated that he was open only to serious inquiries. To me that would stress the firmness of his use of the word FIRM. Then Evan contacts the seller with, in his mind, what he has already told us was his own preconceived notion of what the price should be and with his preconceived notion of whether or not the seller should be advertising on the internet. He then tries to haggle the price. He was told no, the price would not be brought down. He then received a reply, according to Evan himself:
"The AD SAYS FIRM. You should not waste peoples time."

Evan then, apparently as I see it, takes great umbrage to the fact that the seller told him not to waste people’s time because the ad said the price was FIRM. In his initial post, in my opinion, Evan goes on to belittle, criticize and insult the seller numerous times by saying:

1) the seller is pathetic, they do not answer questions or practice any manners or etiquette
2) they are too good for us
3) they don’t need money
4) they are too busy for people to try and buy their animals
5) and then he asks if we think they are brain surgeons or rocket scientists

Evan also sent an email reply to the sellers email in which he called the seller a truly choice expletive.

First of all let me say – I think Evan did waste the seller’s time. I believe, and this is only based upon my gut feeling after having read Evan’s posts before, that he was looking for trouble. I think, he saw the ad and said to himself that he could get it cheaper. I think he was rude in making the inquiry of someone who said the price was firm, or at least that he never seriously considered buying it for the established FIRM price. I think the seller’s reply while short and to the point and maybe even rude - so what - did that deserve a tirade. The sellers response was frank from the seller’s standpoint, he would obviously rather not be bothered by inquiries of this nature and therefor he clearly stated in his sale ad that the price was FIRM, and he clearly reiterated it in his email to Evan. The normal response, in my opinion, would be not to deal with simplysnakes. I think Evan's response was far from normal - could you imagine what he would have done had simplysnakes called him an expletive!

Now what reply did Evan email to the potential seller. Was it courteous? No it was not courteous, it was downright iniquitous in my opinion. (Evan would apparently have us believe we should be courteous in our emails to one another I think). Then Evan runs to the fauna classifieds and makes, what I believe was a totally inappropriate post therein. Why did he write that nasty email reply and why did he post on FC? Some would say because he was insulted and was given a rude reply by the seller. Now tell me, do you really thing that the reply given by the seller warranted the response full of curses from Evan or the post here saying that the seller is pathetic? Come on now!

I think one of the keys to this whole affair is Evan’s claim in his email to simply snakes when he says:
“I have been in this business for ever.”

And then goes on to state that he is a serious buyer. Evan seemingly, at least to me, thinks of himself as the grand poobah of herp dealers. He, in my opinion, likes to pontificate to the point of there being an inquisition when someone is of a mind other than his own. Then when things do not suit him, and when even more people do not agree, he apparently, as I see it, over reacts to the situation to the point of implying it is a conspiracy against him.

The truth of the matter is, in my opinion, that he did in fact waste the seller’s time. If you think he really wanted to buy that herp, then read his email response again (as posted by simplysnakes on page 2 of the thread). What does he say to the seller about price – he says it is a $350 herp, and that he can buy one from Indo and (allow me to paraphrase here) shove it where the sun does not shine into the seller’s body. Well if Evan really wanted to buy a $350 Crocodile Monitor, and if as he said he already knew where to buy one, then why on earth did he try to get one from someone who was selling it for $1,000? Sure he can choose who he wants to try to buy it from, but that is not the point. The point is, in my opinion, that he was never serious about buying that monitor but that he just wanted to stir the pot. He tries to say he is serious because he buys lots of animals every year; however, the number of other animals he buys in a year does not make him a serious inquirer regarding this particular animal.

In fact, based upon my opinion, I don’t think he was serious about getting a Crocodile Monitor at all, certainly not one at that price or even near to that price. I guess the bottom line in all of this is found in one of Evan’s lines from his opening post when he says:
“Large animals are all over the net for $375-750 each, ESPECIALLY MALES.”

Well if Evan is so serious a buyer, would he not have bought one of the other ones by now or at least made SERIOUS inquiries? If he did, I am fairly confident he would have bragged about the inquiries, and the lower priced monitor, or the ACTUAL PURCHASE in this thread just to shove it in simplysnakes face – did I miss something?

This was a thread that was made in poor judgment. I believe (I could be wrong) that both sides admit that it was. They will probably never buy anything from each other.

Will I still buy from Evan?.............YES

Will I still contact people about a lower price even if their Ad says firm?..................YES

This is one of those threads where nothing was stolen or misrepresented. Just two peoples tempers got in the way of what could have been at the very least a proffesional relationship.

What say you to the suggestion of lets move on?

This thread is ugly.

They did not say to evan anything out of line. They simply said not to waste peoples time. Perhaps he was the 50th person to ask about that monitor, or lowering the price or just BSing them. Any of us who have had adds up or sold to the public know how that is. I see it as simply stating that they don't appreciate the way he inquired. It happens, they appoligized long ago if they were actually out of line.

I would still do business with either of them. And I may or may not check into just how firm a price actually is but, if someone said in such fashion as Simplysnakes did to not waste their time, I would take such advice to heart and move on, not have a litter of kittens over it.

This is no longer only about Evan and Simplysnakes since Evan has chosen to make certain claims in his initial post that could effect anyone wanting to buy or sell a crocodile monitor at a fair price on the retail level. He made the claim, and I quote:

Well I do not know croc monitors, but I do know how to check prices and shop for herps on the internet. From what I have been able to tell, in a search on the internet over the last couple of hours, is that Evan's above statement is probably at the very least incorrect, and on the other end of the scale may possibly be a bold faced lie used to make simplysnakes look bad. This was all over a: maybe it was/maybe it wasn't rude email. In my opinion, when I read Evan's post, it makes it look as if simplysnakes is selling at a ridiculously over inflated price. It also tries, in my opinion, to make them look rude, and to be unscrupulous business people based, in large part, on one slightly rude or curt answer to an inquiry.

I decided to search the web on those prices and got different results than those claimed by Evan. My internet search turned up results that really do differ from Evan's claims of these monitors selling "…all over the internet for $375 to $750 each…", in fact the prices I found were much more in line with those offered by simplysnakes. I did the search because I was, quite frankly, curious to the veracity of Evan's claim that these monitors are available ALL OVER the internet in that price range of $375 to $750; just as I was curious to see if simplysnakes was price gouging. It seemed odd that if these were the usual prices that someone would be selling one for $1,000. I thought that maybe somebody (either the potential buyer or the potential seller)involved in this mess was not being as honest as they should have been regarding at least the pricing. I figured that honesty says a lot about someone with whom I may someday decide to do business. It also says a lot with regard as to how I would view future posts on the BOI from either party. So I searched the net determined to find out the reality of the matter. I hit all the ads for the month of July on kingsnake.com that clearly stated in the classified section of ks that they were selling crocodile monitors (I did not search inside of each and every ad to see if they sold croc monitors just those from the overall list under monitors that plainly stated crocodile monitors). I did the same on faunaclassifieds. I then did a web search. When I saw an obvious ad on the list of hits I went to it - there may have been more ads but if was not an OBVIOUS ad on the hit list, then I overlooked it to seek an easier to find one instead of opening every page (in other words if the ad on the hit list said Timor Monitors, Black Throats, Red Ackies and more... - I did not look at it). Likewise, my search criteria on the web was "crocodile monitor" and this brought up lots of zoo and natural history type hits. I searched about 5 or 6 pages of web hit results like this. In all three areas, I found one dozen ads - maybe or maybe not a good representative sample overall, but certainly a good start. My results are below:

Regarding the Fauna Classifieds ads I went back to December 2002 (6 pages of ads).

Based on the above ads, the average price available on the net is about $972 plus shipping for a single crocodile monitor. When a dealer had a pair for sale, or had more than one price, I first averaged that dealer's price so as to get one price for one animal from that dealer. I had 11 prices from 12 ads (one did not show prices). I think they are all different ads - I did not compare names from one to another to see if any on kingsnake matched those on fauna or on the web, and I don't remember seeing any obvious duplicates (there may be some but I don't think so). The average worked out to far above the $375 to $750 price range that Evan said was available on the internet. While some have a price of $750 or lower, note that none are below $475 from those I found. If you take just the four prices from the above list which fall within the range of $475 to $750 you get an average price of: $593.50 - also well above the claimed available price of $375. Don't forget though, the average from all of the above is a whopping $972 - nowhere near $375 and much closer to the priced asked by simplysnakes. In fact the most expensive crocodile monitors from that whole above group were the adult breeder pair which were going for $2,800 for the pair ($1,400 each if both sold separately for half the pair price). So much for adults being much cheaper than babies.

Also note that as far as I am aware none of the above prices include shipping. If there is a shipping charge, I feel, it must be figured as being part of the cost of the animal if ever expect to actually own the animal and you cannot pick it up. Considering that, well simplysnakes price is better than it seemed before because they would have possibly delivered it to Evan at the show.

Evan's claims of what the usual available pricing is for these monitors, has taken it, in my opinion, far beyond the point of Evan and simplysnakes having a disagreement or getting nasty with one another. I do not like it when I think people are giving me a face full of bull, and in my opinion so far, that is just what we received from Evan. If anyone thinks it is not then please, someone tell me who was making a serious inquiry about buying that croc monitor? Tell me that in light of the fact that: Evan stated he knows they are readily available ALL OVER the net at $375 to $750. The whole idea that Evan was being serious when he made that inquiry, and the whole idea of his posting a bad guy kind of thread on simplysnakes because of their reply to him is the only crock I smell here and it has no aroma of crocodile monitor!

Maybe some of you want to buy from Evan, that is your choice not mine. In this case the BOI has done its job as far as I am concerned. I prefer to buy from someone who, in my opinion, is reputable in all of their business affairs and that would include honesty in posts they make about business practices of other dealers. Please bear in mind I am not calling Evan a liar, but I am saying that, in my opinion, I sure find it difficult to believe his claims when he makes statements that I was unable to support with my own research of those claims. Of course, he can always prove me wrong by pointing out all of the current retail croc monitors ads that show the price range he quoted, and then all he has to do is buy one for that price to make a believer out of me. However, I would still forever wonder why he has not bought one already at the lowball price of $375, and will also wonder why he did not do so in the first place. In my opinion, it appears he was flaming, and it looks as if the wind blew the flames back into his own face.

I HATE having to agree with Evan, even situationally on this issue but...

The ads you found weren't entirely representative of this situation when trying to determine the truth in Evan's statements...

I agree that they are not avaliable "all over the net" at the prices he listed, not even close but...

Croc monitors, like every other large monitor, python, boa, tortoise, any other lizard and so on go through a strange price change as the animal grows. Neonates ARE more expensive (as your research showed), then the price goes down as the animal gets bigger... The demand isn't there and there are people needing to get rid of tis lizard that they didn't believe would really get that big (not as common with crocs as it is with Burms or Iguanas, but it happens) and then the price goes up again when they hit breeding size.

If you look at just the animals you found in the same size range as the one in question, Evan's assessment was correct (The average is within the range stated anyway). This doesn't mean that Simply Snakes was price gouging, just that the average market value of the animal under very casual reflection and not taking into account any of the intricate specifics is generally lower than what they were asking.

However, as you said before Glenn... Evan didn't want this monitor. He may have wanted A monitor, but he didn't want *this* monitor, he wanted one for that $350 and decided to harrass some innocent individual with an ad up because he's the MIGHTY EVAN STAHL (Half the time when reading Evan's posts, the movie The Wizard of Oz pops into my head "Ignore the man behind the curtain").

I guess the point of my last post was to point out that they are not as readily available on the internet for $375 as Evan claims them to be. I did not take to any lengthy issue whether or not adults are more or less expensive than the babies, but I did point out in my post that the most expensive individual animal for sale was a breeding sized adult. I pointed this out because Evan had posted that only babies or young ones go for $1,000 plus. He was apparently wrong there, as I see it, as evidenced by the most expensive single lizard from my ads which was a pair going for $2,800 - both easily beat $1,000 and that was without shipping albeit they were supposedly C/H.

By the way, the only reference I saw to size on the monitor Evan inquired about with simplysnakes was that it was listed as an adult. I am guessing that would mean breeding size, and therefor even by what you said, it would command a higher price.

Evan was also pretty darned wrong about them being all over the internet at the price he apparently wanted to pay. I think if he had seen one since at the $375 price he would have bought it already and flaunted the fact on this thread. I could find none that low, and I expect neither could he. That was another and more important point that I was making. He was using the pricing to imply that simplysnakes was charging way too much for their monitor and he used he price statements to back himself up. My review of available monitors does not support his claim. I am all for someone showing me a representative sample of croc monitor pricing that does support him - then I'll change my tune. As it appears now the prices vary widely even for young ones, but none are all that near $375.

Until then I will remain pretty sick of all the people here who trash sellers and buyers by making claims that are, in my opinion, unsubstantiated. This particular thread is one of those as I see it. It just all seems, to me, to make Evan very hard to believe.

Evan - I am sorry that you took offense to my email.
I'm not saying they owed him an apology to begin with but to me that's pretty weak. Would the same apology be acceptable for Evan?

I have known,ad dealt with Paul Moody,owner of SimplySnakes for a very long time,and I am not a prfessional herpetologist,but,I'm learning very quickly.My point is this,I have called Paul sometimes late at night,or even when he is in the middle of dinner,sorry about that Paul.But,he has always treated me with respect,and he speaks to me on my level,as far as my kowledge of reptiles is concerned.I have ALWAYS gone to Paul first,and he has always given me the BEST deals on reptiles,no matter what,or what time of the day or night I called.Being an amateur herpetologist,I have come up with some rediculous questions,and he didn't disrespect me,he not only answered my questions,he answered them in a way that I understood the answer. I'm no brain surgeon, but,when someone has the word "FIRM" in an ad, that is so easy to understand that the reptile in question could understand it.FIRM MEANS FIRM,NO EXCEPTIONS.If Paul has a snake that he raised for sale,and the price is $45.00,I'm not going to disrespect him by offering him $30.00 for it.He wants $45.00.If he tells someone that a lizard is $1000.00,a child could understand that Paul wants $1000.00 for it,"FIRM".Why can't an adult understand that???Then,when this SO CALLED adult doesn't get his way,he tries to slam Paul's name on a website.As far as I am concerned,Paul Moody is THE most fair,ad the most intelligent herpetologist that I have ever met in my life,and I highly respect Paul,and his vast knowledge of reptiles.I have even tried to come up with very technical questions that nobody at ANY pet store,or reptile shop could answer,that I had the answer to right in front of me in a book.In all the years that I have known Paul,I have NEVER asked Paul a question,that he couldn't answer,and he has always been VERY courteous to me when answering my questions, and I know that he truly loves reptiles,he loves his work with reptiles, and he loves helping people get exactly what they need, or what they want.I intend to do ALL of my reptile business with SimplySnakes,and the day I stop,is the day that they bury me. This thread probably shouldn't be on the BOI. It really belongs under the business practices discussions, I would think.

Evan probably overreacted, as he has agreed he did, but it's ridiculous to say that just because the word "firm" is in an ad that one can never ask for a little wiggle room on the price. It simply means, to me any way, that I shouldn't expect to recieve any relief on the price. But to say that someone has broken a barrier of good manners for just asking is a bit extreme in my estimation.

I would not have sent that email to Evan. I would not have reacted as Evan did. I certainly would not have posted a thread about the non-issue on the BOI. I might have commented about the rudeness of that "firm" email, if someone asked about Simply Snakes in a future thread.

If the IP address thing is discovered for certain, that would be an interesting development. In my opinion, that would say a great deal more about a business than any rude email would.
