Gosh, where do I start? After the old site crashed, I got an email from Brian Jr. (Sr.?) saying that he now felt I deserved a full refund (got this saved on disk). I gave him the benefit of the doubt, said ok, and told him to priority mail me cash or a Postal Money order only ASAP. He said great, and that he was glad we were finally getting somewhere. Well, almost a week past and still no refund (surprised?), so I emailed him and congratulated him for being caught in yet another lie. He emailed back calling me a stupid b*tch and various other explicatives, saying he sent the g*d d*mned money. I said fine - send me the Postal Money Order # and I will track it. He said he did not send a P. O. money order, he sent a Certified Bank Check, and quote "..there was a reason for that." Yeah, that reason being you can stop payment on them. And what about requesting ONLY a P.O. money order or cash??? I said that was it, I was taking him to court. He said fine, but I would have to do it in Florida (I'm in Indiana) or he wouldn't be there. That was fine for me, because if he doesn't show up I win by default, but either way I have over 50 pages of info, pics, vet reports, etc. that proves him at fault. I filed here in Indiana, and they sent the papers certified mail. They came back refused. I filed again, this time paying to have the sheriff of their county serve them (both Jr. and Sr.). Well you can't run from the law for long! The papers were served, and the court date is April 25th. I can't wait - it has been almost 5 months since I received the snake in such horrible condition. For those of you who are new to this story can email me for the gruesome details and pics of the snake then and now. After 3 months of being quaranteed and recuperating, she finally eats one mouse (she could easily eat 2-3 medium rats at a feeding) every couple of weeks. Now those of you whom are experienced with WC's, does this sound familiar? "...will only eat mice....one at a feeding....once or twice a month....hmmmmm." Now I have been talking with some of the top ball python breeders about my loss of income. I have two very large female ball pythons that I was going to breed to the "het male". I gave each females weight, length, build, age, etc. and asked each breeder how many eggs on average each one would have, multiplied by how much 50% het for albinos were going for. That total came to anywhere between $2500 and $2750. Add that to the initial cost of the ball python: $350, plus court costs (so far): $79, plus Prime Rate Interest, plus postage, phone charges, etc., and you get a total over $3500 - ten times what it would of cost to just refund my money in the first place. Now Indiana law only allows a maximum of $3000 for small claims, which is what I am going for, but even if the court rules that I only get my $350 back, at least I can say that I put a stop to this jerk from abusing anymore animals and ripping anyone else off.

P.P.S. I had also talked with Florida Fish & Game, who went and inspected their house. The inspector said that the only thing he found was a iguana in a cage too small. Where'd all the snakes go? After all, Brian Jr. was a "big breeder". No wait - Brian Sr. said he only had five snakes, so where'd they all go??? Default judgements are pretty much useless. You hit the nail on the head when you said "anything in their name" can be garnished, but that's the key. It has to be in their name and their name exclusively! If my home is in my name AND my wife's name, you can't touch it! The type of people that get these judgements against them are masters of the system. It's quite simple, they don't put anything under their name.
