Prior to this big order being shipped to us, we shipped to Ken twice....our animals...which we never got paid for NOR received anything for shipping...

Ken....you state you have a bank record to verify that you paid us for those animals....you said you would copy and post it....where is it?

You are getting the remainder of your animals...that is not being disputed...and we are not charging you for the cost of medication, food or time.....for the month they were here....so on Tuesday, you will have your whole order.

After that, when you look at the firgures....you owe us:

All our personal animals we sent to you.
Shipping for all orders here.
Shipping for orders to you.

How can you even say you lost anything on this? You didn't lose a dime...you have (and will have) all of your animals ordered....plus animals that don't belong to you.

I thinks that about does it....still looking for what the shipping cost me from US Global here....

All you have to do to out her in her place is just show proof, If you can't then pay them what you owe them. As much as I hate to say it your case dosen't look too good right now.

You do own the web site domain (as I see it), but you must prove your case on everything else.

I would like to believe you given the reputation of these people to rip anyone and everyone off that they can, but without the proof you are in trouble.

She is a good con artist and keeps every piece of evidence in her favor. You can tell she has had a lot of practice in the art of deception.

medication,,.? am I missing something here.? are there some sick animals being shipped to Ken..? Or are these animals that only some were sick and not seperated from other animals being shipped to Ken..?are you shipping animals that are under a med program???? As known some viruses take a while as do bacterial infections[ more than just a few days]
Also if these animals had anything wrong with them wouldn't you want the balance in funds back Ken???

I do not mix the two..first of all...the $1500 + $60 is money owed to ME for site design. PERIOD. Seperate issue, seperate money.

Second of all there's no $5200 in animals. Not even close. Read your emails you wanted me to send to you...read them on this thread...they're posted...the one's you said you would have your "staff" review in the morning.

Third...we DON'T WANT YOUR WC IMPORTED NON FEEDING ANIMALS. We want our cb feeding animals back we sent you and you never paid for and want to be reimbursed for shipping on your animals. I'm not asking for you to pay for all the mice/rats we've fed all your animals since July, we're not asking for you to pay for all the flagil and such that your animals needed...AND we're not asking for your animals....we are sending them to you...

YOU are the one who wanted us to care for the animals as you were going away on your cruise and your store wasn't set up for them...and we did. We sent you the HEALTHY and FEEDING, sellable animals, plus our own personal stock....you wanted us to keep the sick non-feeders here to get them going so you would not have a problem with having the thin snakes in your store. But we no longer feel it's fair to continue feeding them, and keeping them quaratined....we've done all this for over a month already.

It's obvious we sent you all the feeding healthy ones out of the shipment you ordered...you're selling them on various websites.

I suspect this registration was done on the fly by someone whom wants to post as an alias. Once they got the registration verification email, the email address was no longer needed.

So I did a search on the IP address used by "snakekid" (68.32.242.72) and checked to see whom else might match up with it:

Also, what happened to this deal? Now you want me to keep your sick non-feeding animals???

Now, I pose a question to people here on the BOI:

I have Ken's non feeding WC animals here...some of which if I send it I know will not make it...(not all, but some). So what do I do? Do I send the animals, like I want to, so he can send me mine? Or do we continue to feed treat and house them here (which I don't wany any WC animals....I've learned my lessons with WC imports)?

And if we keep them here and nurse them to health, what we can...then what.

Did your lawyer tell you that you should prosecute Upstate Exotics, Ken? Really??? I thought only the State could prosecute anyone. You are free to sue whomever you wish, but prosecution is a very specific thing. I'm surprised that your lawyer would not explain the distinction to you.

Ken, I told you earlier, in another thread, that you need to post your proof here, rather than creating other threads of doubtful purposes. IF you are telling the truth, please just post it here. If not, then cut to the chase and be gone!

Just a little info

Ken has gone home and is scanning in documents needed for proof here. He is not very computer literate and I had to show him the BOI after someone emailed me and told me I should take a look at a thread about Upstate.

I sat down with him this afternoon and looked at a lot of paperwork (emails, invoices, airbills etc) and told him what he needed to post tonight.

Didnt anyone catch on those airborne invoices from Allison for the 164lb shipment that they were billed to the receiver? (bill receiver box checked) I saw the invoice from airborne on our acct statement this afternoon for myself on those 7 boxes weighing 164lbs.

I started working for Ken on 8/25/03. James and I took 13 hours that day inventorying every animal in the place. It took several days to get invoices from US Global on what all was shipped so that we could match things up. Ken can post the fax letter from US Global stating they were sorry it had taken so long to get the invoices to him. Ken and I then sat down and compared my inventory list to what US Global invoices said was shipped. Lots of animals were missing. I can honestly tell you we have tons of animals in the freezer and I had Ken take some digital pics of most of them before he left here earlier.

Just some of the comparisons:

86 burms shipped-we received 40

100 mississippi maps-we received 25

2 macklotts-we received 0

7 66%het albino boas($1400 worth right here)- we received 0 again


This is just to give you some idea of what was sent to them and what we received from them. MOST of the burms from them have gone into the freezer, we have several other suppliers of CB burms and that is what we are selling on k.com.

Before this deal Ken "had a few snakes" and had no idea exactly what he was getting into with this deal and he will be the first to tell you "he was an idiot" for doing this. As far as ordering WC animals, the animals ordered were on the suggestion of Sal. From now on we will be focusing on CB animals as long as im managing it. Ken didnt know any better.

As for Ken having me post that first post of mine, no he did not. He was not even in the office when I posted that post. As I stated earlier someone sent me a link saying you need to check this out so I did.

As for the so called hacking, all we wanted was the domain in our name as it rightfully should have been from the start. When Ken realized this was probably not going to happen and we had the login/cpanel info yes we deleted the files. Ken really is clueless on website stuff.

As for the Ceylonese python, Ken had no idea what a Ceylonese even was and I had to tell him they were not to be sold/shipped across state lines, he was clueless. I had not seen any invoices from Sal on that shipment when I did my inventory and assumed it was an Indian/Burm cross or something, not a Ceylonese. I will be contacting USFW on Monday on this matter. I personally am not familiar with either of them to make the call as to what the animal actually is.

I think im done with this post, im ready to go home now.

No they did catch it and it states that KEN PAID SHIPPING TO HIM. But that shipment to US was never paid...besides that..the order Ken made from US Global for 100 CA Boas directly to him was put on OUR airborne account....I didn't authorize that....

Regardless when you started...his order went out on the 20th....5 days later you finally decide to check inventory...that was just about the time I suppose you all started telling customers you weren't partners with us. But the funny thing, is I never heard we were no longer Partners after you posted on Kingsnake. Kinda Funny....

Also why were you waiting on invoices from US Global when we sent Ken a list and spoke with him on what he was getting...he OK's the shipment before it even left here.

No...Ken knew every step of the way what he was doing. He sent the check to US Global...he saw what was going to be ordered, he saw what we were going to ship, and he received the shipment.

Again, he wanted to stock his store up, bought FROM A WHOLESALER all at WHOLESALE prices...what DID you expect Ken...did you expect to pay $15 for a baby burm and get a perfectly healthy big fat CB baby?? You're a business man you saw how to get alot of animals at a decent price to stock your store up.

So is THAT when you tried accessing my Moonlit Media account...when YOU realized you couldn't have full access without payment...ok so YOU did this on your own, as Ken is so computer illiterate. Ok.
