    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Credit card stacking

Just to shed some light on the sharing of terminals between two stores: it is called credit card stacking, and it is illegal. No person or business may run credit cards through another business account (either electronic or manual). It is indeed considered money laundering, and could result in the ban of either party ever being approved to accept charge or debit cards from any banking institution. OK, resume your positions.

Now that more light has been shed on Upstate's unscrupulous actions I would definitely print this thread out, send a copy of it to your bank, a copy of it to the FTC, and possibly the IRS. The FTC and IRS will not look to favorably on this type of behavior and I am sure that with that information, and the previous information you have proven if you take them to small claims court that you will have your refund. As I have said on here before with every post they Dig their Grave Deeper and Deeper

I just have one last question. When you say that these transactions were run through your "partners" machine, is it safe to assume that you are incorporated together? What percentage of the corporation do you and Sal own? And is this another herp related business?

Even if they are incorporated, have a legal parternership, or anything else of that nature, it is still money laundering. You absolutely can not run one business' assets through another. It doesn't matter if there is a paper trail or not. That's just called evidence.

Some simple advice. You seem to think every one is stupid who reads this thread. You seem to think you are smarter than everyone you screw. You should know that many of the people who read this own their own business and know the laws, they know right from wrong. They are not stupid or ignorant.

The people who don’t sell herps or maybe hobbyist are not stupid or ignorant either. You forget that this site and love of owning herps brings all types of people together, honest I mean on this particular note. School teachers, accountants, doctors, lawyers, IRS, FBI, medical, construction, law enforcement, And so on and so on.

You also don’t exactly know who you’re screwing over. Alison you have damned yourself with your own words you did not need help from anyone else. I told you when you should have stopped at the beginning of this thread.


The last time I checked there were 16,000.00 views on this thread. That’s a lot of potential different reads on this thread. You have to think when you’re reported to any various agencies, I guess it will be hard to know who actually did it.


Alison every time you open you email you have to wonder what the message is going to be. Every time you answer you phone you have to wonder, IRS or maybe some other agency? Or just a Joe Schmoe.


Ivestigations with the IRS do not happen over night, sometimes they take a while.

This is outrageous...

I've been watching this thread for a while now and I'm completley shocked. Not only will we never do business with upstate, but we will do anything we can to help. Time to break the silence...

We are located in Western New York, Right outside of Buffalo. I would be happy to bring the proper attention to this matter to any local authorities who should be contacted in this matter.

After seeing all of this, and especially the disclosure of private billing information which is a direct violation of numerous privacy acts, I am SURE the BBB and numerous other local agencies would just LOVE to investigate this. They've basically dug themselves into a perpetual ditch and there is no way out of it. This is all set in stone and they cannot do anything to remove all of their statements. the same statements here that contradict each other statement and confirm their own lies.

This makes me sick. Atleast if they are going to lie I would think they would put a little more thought into it and try not to crucify themselves which they have DEFINATLEY done in this thread. In a court of law I don't think they would have a single prayer in the world. Not to mention from that Rip Off site that was posted a few pages back, they already seem to be in the books with quite a few angry customers from thier other "home improvement" business. It seems theyre days of taking advatage of hard working people are numbered.

Unfortunatley it takes an honest person to actually FOLLOW THROUGH with their claims. Someone needs to step forward and stop them instead of simply voicing thier experiences and then doing nothing about it.

My question to you tony is: Are you going to take action on this matter when and if the time comes? Or are these empty threats? What have you done so far to bring this matter to the proper authorities? File any claims? Police/Theft reports? Anything?

We'll do anything we can to help, just say the word. But I'd like to know we will not be wasting our time doing so. If you are completley serious we will follow through for you no doubt about it. We're downtown atleast once a week, if theres anyone you would like us to get in touch here in Western Ne York to get the ball rolling with now is your chance. Don't waste it.

Just thought you guys might be interested in the reply I got from the BBB:

"Company called today and waned [sic] to respond over the phone rather than in writing. She said that the consumer has changed the story several times and she said they were not contacted that the snake had died. They have their guarentees [sic] in writing. She would of given her $17.50 for the DOA snake but she did not follow the guarentee [sic] policy. Company says they have emails saying that the consumer said she was satisfied and she could email them to us upon request. They do not refund on shipping. THey said if there was a problem on their end, they would pay for the vet bills. No refund will be given because she did not follow proper refund policies and did not even try contacting them. Everything was stated in the emails she was sent."

The only thing that is true about this is that you have your guarantee policy posted, Alison. You got me on a technicality (posting onlist instead of to you directly since you were subscribed to the thread), but you've lied all through this report. I will be replying to this to the BBB. Maybe it will in some way help Tony with his claim.
 
After reading about Upstates partner processing the card I am wondering if this is a platform for giving them another excuse for not issuing Tony a refund.
I am fully expecting Upstate to post something along the lines of "They have now found out that their partner told them he issued a refund but they have since found out that he lied to them and has left them holding the bag".
This would once again follow Upstates mentality of trying to convince people that they are the innocent victim in this matter.

Oh I'm sure something along those lines is to follow, but the best part about anything they say, is we have over 35 pages at this point to browse thru for NUMEROUS statments of theirs which contradict everything they try to pass off as current "truths".

Everything thay have said in this matter is going to come back to haunt them, it already is.
 
The good news in all this is that Upstate are getting a ton of BAD publicity!

This decreases sales to unsuspecting customers. And let's face it, you have to unsuspecting to buy a parasite infested animal advertised as captive Born and ................(now the funny part)....BRED!

Has anyone else noticed how many Web sites Upstate's now has? Having multiple websites is not a problem but with these characters it looks like they are trying to get more buisness started to they can fold UpState Exotics and start over with a clean slate. Just my observations and opinion but what does everyone think about this?
Alison what is your reasoning behind this? I for one would like to hear your answer on this.
 
I dont think they are trying to "fold" the business at all, I think they are trying to create numerous platforms to acquire more business, maybe to make up for the business they have lost due to incidences like this. The more they force themselves into the publics face by making numerous sites, the more they feel they can acquire new unsuspecting victims.

At this point they can make all the sites they want, bottom line is their customer base will consist mainly of those poor unsuspecting customers who do not know any better, and customers who wish to be ignorant to simple facts.

They obviously feel the more sites they can have pop up in a search engine querry the more business they will obtain. Its true, but they've seriosuly lost any chance of having a reputable business or dealing with knowledgable or reputable clientel.

Now they are targeting anyone they possibly can to make a quick buck. Mainly those who are uneducated and or ignorant.

For example, An uneducated customer walks into a petco or petsmart and is sold on baby albino burm, or maybe a boa. Reguardless. They dont know what they are purchacing. Only this way people looking to buy ONLINE are going to do a search on the web, and come up with a number of sites, and someones bound to stumble onto one of theirs. And they figure the more sites they make, the more chance of getting these customers. And guess what? They will GLADLY take their money. Just look at their previous posts. They are THANKING us for bringing them traffic!

It's all about the allmighty dollar to them.

Tony, I hope you pursue this aggressively with the credit card company. Not only for the $180, but for the invasion of privacy. I hope that the "partner" at that time was aware that what he/she was doing was illegal, so at least the damages to them will be justified.

This is so disheartening.

The answer to the question what name appeared on my bank statement for the dates of 03/28/03 for $100.00 and 04/01/03 for $80.00?



I will tell you this much, it does not state Upstate Exotics. The name showing when my funds were extracted was I believe to have shown Greenwich New York. Point being it did not show as Upstate Exotics. I will have the exact name and spelling as soon as the copy of March’s statement arrives from Bank of America. More proof for Alison since she does nothing but challenge and call her customers liars.

Alison, it is funny that you claim that you gave me a refund on 03/28/03 and 04/01/03. This is the so called proof you provide on 08/14/03. These are the same dates that you denied referring to pertaining to my refund on 08/12/03.

Alison you’re a master at side stepping the truth but the jig is up.
