    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Upstate Exotics.

Hi,
What is the definition of this? (It wasn't an instant "I want a refund").
And for any one who cannot follow the facts, in the quote below it says "at first he said he would wait for the paper work". When was the paper work discovered missing? That's right; it was discovered missing on 04/06/03 not 03/28/03 or 04/01/03. The chosen dates Upstate Exotics claims the refund was suppose to have been given.

Nothing but perpetual contradictions with all of upstate Exotics so called proof and statements.

Maybe you should clarify to upstate how often you have been in touch with your bank?
They dont seem to understand that as persistant as you are that you would not forget to check with your bank.

Hi,
I have been in contact with Bank of America constantly. Let’s not forget it’s a visa debit card there was easy access online information. Before I came forth with this thread I checked with Bank of America by phone and via internet every other day at least, I mean upstate was avoiding me I could not get the information from them. I was in constant contact with bank of America up to 04/30/03 when I opened my claim number against upstate Exotics. You have to remember they cannot open, I repeat open a claim if you had in fact received a refund credit to your account. I have been in contact with them since the claim has been opened. As the documented proof shows as of 08/04/03 it is still active. That’s just documented proof the claim is still open.

I could have just stuck to all my stated facts. That within its self stood strong with the email verifications. I did not have to show any proof. All documented proof concurs my previous statements, my original posted claim against upstate Exotics.

Let’s not forget who the victim is. Every time some one has a problem with upstate Exotics, Alison throws so many smoke screens people cannot see clearly any more. I am not on her back, and please don’t take this the wrong way, customers should not have to go through all of this and be treated with such disrespect.
No decent repeatable company conducts these types of actions against their customers. Alison always plays the victim. The blind leading the blind. So many hard core facts and people still don’t see the plan truth.

I was totally taken advantage of; I trusted my personal and private information with upstate Exotics which in turn was given to a third party without my consent. My money went into that persons account per Upstate Exotics. I paid for an item I never received. They miss represented the item on their website to get me commit to the purchase. They avoided me since 04/06/03 even with me placing numerous phone calls and sending them emails. On 04/19/03 I told them via email I want my rightful refund. So from 04/06/03 -04/19/03 they did not respond to me at all. After 04/19/03 they disappeared again totally avoiding me until I came public on 04/30/03. The first time they lied publicly about my refund was 05/01/03. Where’s my refund $180.00?

or does anyone else feel that Alison seems like she comes from another planet? Her thought process, rationalism and overall mental make up come out of left field? As I read her posts, I often end up with a puzzled look on my face........what the .......?

Please answer the questions that are asked of you rather then avoiding them a babbling on incoherently. You have yet to answer Darin's question or my same question that was posed to you yesterday. YOU told everyone, at the end of last week that YOU spoke to your business "partner" and that he was faxing YOU the information regarding Tony's refund. Several people have inquired about the status of that fax last Thursday, 8/14, last Friday, 8/15, and again yesterday on 8/18. Each time YOU responded YOU said that YOU were still waiting for the fax and that you wondered if you would get an apology when the PROOF was posted. What happened to the fax? Time after time after time YOU have proven yourself to be a pathalogical lier!

Why is it so hard for you to understand why nobody wants to back you up or support you?

Have you and Sal ever considered just moving away from your Herp business (or lack there of) and going into another field? May I suggest you stay away from the contracting/home improvement gimmick as well. Maybe a used car lot or something just leave this business/hobby to the people that really love the animals. You are not only destroying yourselves, but leaving a very bad taste in the mouths of new herpers that you have ripped off.
 
Just for the record, I don't disbelieve Tony at all. I have no reason to do so. I was just trying to paint the best possible scenario for Alison for the sake of argument to show that, even if true, it would not matter in the slightest regarding her culpability.

When I made reference to getting you off her back it was in no way intended to insult you. In fact I admire the fact that you are so persistant in your quest for relief.
I believe you when you say you have not gotten your refund. I believe upstate owes you. You have provided all you have, they have provided nothing. You do not have a track record here of lying, upstate does.
As far as I am concerned you are the victim and should be re-imbursed.
In my opinion I would go so far as to say upstate really needs to find a different type of work, unless they do a complete overhaul of the way they do things and thought processes, I can't see them getting too much further without burning all their bridges.

Sorry to hear about your misfortune with Upstate Exotics. Seriously if I were you I'd take them to court. It seems to me that if they were going to refund your money they would have done so and stayed in contact with you. They failed to do so. I know the country is sue crazy but under certain circumstances such as your own I think it is necessary. You can take them to small claims court and even ask the judge to order them to pay your court costs. I'm not a sit back and wait kind of person. And from reading your e-mails in your post it just seems to me neither of them are to worried about getting you your money back. I think any judge in the country would agree. Maybe then they will see that they can not just treat people like that and get away with it. Even if you just call them and theaten to sue they will probably contact you pretty darn fast. Also you should write a complaint to the better business bureau, and every reptile forum you can find to warn other people about them.

I think the only way you are ever going to see your money again is through a law suit. You first posted back in April, it's now August. That to me is just unbelievable... They have had more then enough time to get you a refund. I don't know what the statute of limitations is for this case but it's probably only a year or so.
I'm relatively new to herp trading and breeding. I honestly thought for the most part all herp breeders to be honest people. I am glad I came across your post, I will definately be more careful in choosing where to purchase my reptiles from.

Dennis, that is a good one, and you hit the nail on the head. As I've been reading this and the other two threads in question I've had to shake my head.

Upstate is asked specific, pertinent questions. Sometimes I feel like the level of conversation is like the following example:

Guy: What color is your car?

Girl: my cat's name is Tasha

Guy: Did you see that hit and run accident:?

Girl: You're a big bad meanie.

Guy: Do you understand english?

Girl: You'll apologize when you find out you were WRONG.

I don't know if this example is necessary, but sometimes I feel like this is what we are getting. Two soundtracks!

Upstate said that they weren't posting on here to see how low we would all stoop (not a direct quote).

I find it fascinating.

Person A, B, and C ask Upstate specific questions

Upstate doesn't respond.

A, B, and C restate the questions

Upstate doesn't respond.

A, B, and C, wearily, restate the questions, several more times.

Upstate finally comes back, NOT ANSWERING THE QUESTIONS, commenting on the behaviour of the ones asking questions.

They just must NOT understand that we actually want answers to the QUESTIONS WE ARE ASKING. Or their social structure on their planet must be that a person who asks questions is THE BAD GUY.

Upstate: POST YOUR PROOF. That's ALL YOU HAVE TO DO to shut this down. POST YOUR PROOF. Don't call people names, post hearsay, and dance round the question.

It is nice to find out more truth about your lies myself. I just talked to Lauren and she never said anything of the sorts and has not banned me from her shows. Like I said before in my post I left the show on my own accord due to mechanical problems with the location that the show is held and not because I was banned or asked not to come back.
And again on Wayne's show, I choose not to do the show after the fiasco of Jacksonville's Expo and being told I had to do that show in order to get my table at Daytona that year as well as the vendors that are allowed to bring tables full of imported fresh wild caught animals that are un mistakably wild caught but yet he will tell others that they can not bring any import or wild caught animals no matter if they are LTC.
Sp good try again on trying to shift the focus to something else and not where it belongs RIGHT ON YOU AND YOUR BUISNESS So now again to get down to the nitty gritty GIVE TONY HIS REFUND !

Hey Good Herpers I find it funny that someone has tried to send me a virus after my post. They got me once a while ago. It wiped out all of my email. Everything. After posting in a few select threads this year I was sent these viruses. It always happened when I had something negative to say about certain businesses. Now it has happened again. Could it be a coincidence? I think not.

WHAT A DEAL!!! Oh and now I have your $180 so there is no need to go through the trouble to falsify documents. Plus I wouldn't know where to start. But I'm working on it. Just in case this happens again. If I knew how to do it I would have taken the rest of Tony's Money. HAHAHAHA.

As for the Statute of Limitations. I will ask my brother who is a NY State Trooper what the Statute is on Money Laundering next time I see him. He should know. Right? The Feds would handle it but I think a Trooper may know.

Now.....I don't have a business, so I don't fully understand the pages you posted....besides, the last one is so small that I can't see it.

I would be the first to post an apology....strike that.....a pat on the back for doing the right thing....if in fact I am wrong about what I am reading. It appears to me that these ae chargeback notices from YOUR bank stating that TONY'S bank was disputing the charges. We know that that happened...Tony told us it did.

If the funds ARE in Tony's account, all that proves is that you didn't dispute the chargeback. Basically, you agree that he should have the money back. That I like....(pat on back)

However. Since you did not post any evidence stating that YOU personally refunded Tony's money, I don't think that you should EVER receive an apology from anyone. Basically by not disputing the chargeback claim, you didn't argue that he should get his money, but you also never gave him the money yourself.

I might have missed it, but is there a date on the letters from your bank? The only dates I noticed were the ORIGINAL transaction dates (so don't say that those are the dates of the chargeback, because it's relatively impossible to chargeback something on the same date)

The way I see it........you took tony's money on 03/28 and 04/01.

Tony filed a claim with his bank.

His bank filed a chargeback with your bank.

Your bank notified you of the chargeback.

Did you have to do anything to approve the chargeback? (or did your "partner")

I noticed that it says "if you feel.....is unjustified," but never mentions if any action was required on your part. Just curious.

I still don't think that you deserve an apology from anyone, especially Tony, due to the fact that it first off took so long, and you didn't voluntaily GIVE Tony his money back, but rather LET his bank claim it.

All in all, from all 3 posts that you're involved in, I've learned a few things......first off......you sell a lot of animals that tend to die, very quickly I might add. Second.......You don't care....about the animals or the customers. And third..........when YOU make a mistake, or have an unhappy customer, you try as hard as you can to put the blame on anyone elss but you. You also never try to remedy the situations to the customers advantage.

In my opinion....Good companies are the ones that go above and beyond the expectations of the customers. I bought a baby green bush viper from a vendor at a show once.....VERY young, it wouldn't eat and then died a few weeks later. I told the vendor in passing, not expecting him to do anything, just wanted to give him an update, and he sold me another one at half price.......THAT is a good seller. I know that he must have lost money on the second snake, but he didn't care at all.....he just wanted me to be satisfied.

Customer satisfaction is what drives this industry if you hadn't noticed. I would suggest that you stop selling garbage animals, or at least keep them at your facility until they are REALLY healthy to be sold, and by all means, go the extra mile to make all customers leave every transaction feeling like they just made the best deal of their lives. That is how you make people come back and WANT to do business with you.

At one point in this thread, I even thought about buying the amazon tree boas that I wanted from you, just so that if the deal went smoothly, I could come here and tell everybody. In reality, I just don't trust that idea. I can't take that big a risk, and have the potentail of a month long problem, just to get a few snakes.

If you change, I will certainly look you up. But I'm not easily swayed
