Bad Guy Victor Rivera at Reptiles Plus is Untrustworthy!

Calling him entertaining is not even close. He's just hilarious. He called my store about 4 times today and just cussed me out forever. The first call was fairly civil as he complained that every animal I ever sent him has died. Then I finally asked who this was, and he said Victor. From there it just got ugly. You could hear the tension in his voice, he got louder and started talking faster, and every other word was a swear word. I was in the middle of helping customers so I was forced to hang up. He called right back, and this time it was just a man red face screaming at me. I found it very amusing, but once again I had to work so I hung up on him. He called again, and just started where he left off, and I hung up on him. Then he emailed me. I replyed. While I was doing that he called and talked to one of my staff, swearing and ranting. Said he did not want to talk to me, but that I should plan on being sued. I told my employee to go back to work and forget about the call. In the meantime, on the computer he has threatened to destroy my business single handedly by causing my suppliers to stop selling to me. I'm amused still. So, lesson learned is that if you do post against this insane person, he will call and harass you if he can, or will email and harass you for sure. All in all very funny, and made my day. Now all his stuff is heading for the spam place. You can have too much of a good thing, and he's reached my limit. Take care guys, and good luck.

Why is it that whenever some low life goes out of control, this first thing they do is threaten a lawsuit. I doubt he has the money to hire an attorney, and I doubt any attorney would represent him after he has admitted shipping snakes USPS on an open forum.

Thanks very much for the sympathy, but I really don't mind. It was fun listening to him rant and swear. My life is kind of dull sometimes, and this just helped make the day more festive. I see he's looking at this thread now, so he must just be going bonkers right now. I can just see his eyes budging out, perhaps a vein pulsing on his temple as he plans on ways of making me pay. He is a loon you know? Not even close to being normal. I bet he's as unhappy as a porcupine in a balloon factory right now. That will teach him to do things right next time, and if he screws up again, perhaps he'll be big enough to admit it. On second thought, nope, I don't think he ever will.

If he and the two of y'all should ever actually all be together in the same courtroom, I'd fly down there and pay to see the entertainment and I bet we could get a courtroom full.
I'd love to see the judge's face as he (or she) reads this thread and realizes this guy actually admitted in writing to shipping snakes USPS.
Then we could all go out to dinner while Victor would be no doubt chowing down on much more humble fare.......

LOL! I am still reading through this whole post (can we say dejavu??) I did want to point a couple things out. When my order was going through with Victor (as you can read from my original posts) he too assured me that my cham was being shipped via UPS I then confirmed that with him over the phone when I placed my order. Then the day he shipped he gave me a tracking number which began with US at that point I ask why would there be a us at the beginning when he said it was coming UPS, he then said oh no I meant USPS, yet he assured me on several occations it was UPS. I let him know over the phone that I was not happy about that at all as usps has lost packages of mine in the past.
Also He claims in this post below he is his OWN boss, yet with my transaction he claimed his partner would not allow him to refund my money. So which is it???? One minute you DO have to explain yourself to someone and then the next you dont???
It is pretty clear as day on that box it was sent via 2nd day and not over night, but classic Victor, puts the blame on EVERYONE else except where blame should obviously be placed.
This guy is such a SCUM BAG! OUT FOR A BUCK AND THATS IT!!!! Great way to run a reputable business Victor! lol! You are such a joke! hahahahaha!

Victor called me 3 or 4 times in a row yesterday from a blocked number, I finally got irritated and answered the phone, he wouldn't give me his name. He had gone through all of my old posts and was trying to be nice, once I figured out who he was, I hung up.

He immediately called back a couple more times, I just pushed it to voicemail....he left a somewhat cordial message and did not swear at me or anything, like I've read in the previous post. He also emailed me. I will post that at the bottom.

Just to clarify, when I mentioned he said he wouldn't do parking lot deals because he'd been almost arrested by the cops, I was referring to parking lot reptile deals, not drug deals. He claimed I was inferring that he was selling drugs and I was lying. I stand by the fact that he told me he would not meet me somewhere because he's had trouble with the police in regards to selling animals.

Oh, and in his voicemail he said something to the effect of "We don't allow pick-ups for security reasons, How do I know that you're not going to rob me?" Funny that he's worried about being robbed, considering how he's robbed a few people on here, and I'm sure many others.

I was wondering if the original starter of this thread has had a chance to ponder Reptiles Plus' allegations of how the pics may have been taken without styro, etc.

I was also wondering if the owner of Reptiles Plus has been in contact with that customer---since he seems to have some time available to contact others.

was this merchant doing business in a state other than your own? because if he is then the transaction might be protected under interstate commerce. Even if the merchant is in the same state as you you should still go ahead and file a complaint with www.ic3.gov.

IC3 is the federal governments central hub for internet fraud claims. You file a complaint with them, it gets analyzed and then gets kicked over to the appropriate law enforcement agency which is nice because you don’t have to worry about figuring out who you should contact.

I can tell you from personal experience that claims filed with IC3 are taken very seriously and if you have a legitimate claim and results can obtained within a very short period of time
Not too long ago a certain well known merchant off of kingsnake.com got a very nasty surprise when the FBI showed up looking for him and simultaneously Kingsnake.com put his account on hold after he tried to very boldly screw me out of my money in a very similar fashion as what happened to you. I tried negotiating with this guy for over four months trying to get things right but to no avail. Needless to say, once the FBI got involved within a couple of days he not only gave me a full refund but even gave a little extra as a way to appease me and hopefully get me off the rampage path. I never actually heard from the FBI myself but within a few days of filing a complaint I had the merchant calling and emailing me constantly trying to get a hold of me and leaving me messages to try to resolve the problem and literally begging me to call off the FBI. I thought this was hilarious since for the previous four months he had never taken the initiative to contact me to resolve the issue plus it was great to know a disreputable merchant was getting what he deserved. so I know my complaint was acted on.

Another thing to do is file a police report with both your local P.D. and his P.D. you never know, you might get lucky and get an officer who is willing to drive to that individuals residence to investigate which could result the matter being resolved out fear for further action.

anyway I'm sorry this happened to you. Let me know if I can be of any assistance. Since I've been through this before and successful handled it, I might be able to help by giving you some advice on how to go about resolving this.
 
Hi. With respect to Mr. Rivera, I wanted to let you all know what was going on.
A few nights ago, Victor called me and discussed his side of the situation. He was very polite and respectful. He also acknowledged that he made some mistakes with shipping and packing. Under the circustances, I thanked Victor for his honesty and willingness to admit his mistakes. Victor assured me that this type of transaction will not occur again with future customers. He also told me that he would have to discuss the issue of a refund with his business partner.
Last night, Victor called me again. As before, he was polite and well-mannered. He respectfully asked that I would removed this thread from the forum. I informed Victor that, to the best of my knowledge, I did not have the ability or authority to do so. We were unable to agree upon terms for a refund, but I respectfully thanked him for his acknowledgment of a mistake and I informed him that I will no longer post negative comments about his business on this forum, or any other forum online. Again, Victor assured me that he does care about the customer and that he will make great efforts in the future to make sure that this type of misunderstanding does not occur again.
Whether or not I believe Mr. Rivera at this point is not important. I try to be an understanding buyer (although sometimes I get a little angry when mistakes are made) and I make an effort to treat a seller with respect, even though I may disagree with his business practices. As I said before, I have spent many years in the private business sector. I understand that mistakes are made. I believe that businesses, including Mr. Rivera's, deserve their fair share of chances to make themselves right.
I will make myself VERY clear in stating this: I still believe that Mr. Rivera was negligent in this transaction. I will also state that everything that I posted in this thread is TRUE. I DID NOT lie, or attempt to shift blame upon Mr. Rivera where it was not warranted. This includes the accusation that I "removed the insulation from my package for the picture" (I believe that brrrman's statement that his package from Victor was packed the same way...with NO styro, clears that up).
I do, however, believe that Mr. Rivera should be given the chance to right his wrong at this point.
He was responsible enough to call me on the phone, admit his mistakes, and assure me that this type of transaction will not be repeated with future customers.
Out of respect to this responsibility, I will have to give him the benefit of the doubt.

I attempted to stop posting on this forum many days ago. Not only to stop aggravating the circumstances, but also to honor Victor's request that we settle this disagreement between us privately.
When I originally posted this thread, I did not intend to get into an argument with Victor, or anyone else, about this transaction. I also did not intend on getting anyone else into an argument with Victor. I simply wanted to give the facts so potential customers could be well-informed if they decide to purchase from Mr. Rivera.

I sent Mr. Rivera an email tonight explaining where I currently stand on this issue. The main points of this email are that I accept that fact that a refund will no longer be issued, and that I will no longer post negative comments about his business. This is the email that I sent to Victor this evening:

"Hi Victor. I just wanted to let you know that I looked into removing the thread from Fauna classifieds and it clearly states that I do not have the ability to edit or remove this thread.
Unfortunately, it looks like I wont be able to meet your requirements for a refund at this time.
I do, however, appreciate you calling me and discussing this matter with me over the phone and admitting your mistakes and accepting responsibility for this shipping and packing mistake.
I hope from this point on that you honor your word and do not cut corners in packing and shipping and that you try to treat future customers with respect and own up to your mistakes.
I am disappointed that we couldnt reach an agreement that resulted in a refund for this shipping error regarding my order, but I am willing to move forward at this point.
I do not want to continue to post responses on the Fauna classifieds and I do not want to get into any arguments with you, or any other members of the forum.
From this point on, I am acknowledging that any differences or misunderstandings between us no longer exists.
I will no longer harbor any ill feelings towards you, and I will no longer post or promote any negative comments about your business. I will simply move on at this point and put this upsetting transaction behind me.
I understand that mistakes are made in every business. No one can be perfect. I just hope that from this incident, you have learned to be a more responsible shipper and that I have learned to be a more informed buyer.
To satisfy the curiosity of the other forum members, I will post this email on the thread to acknowledge the fact that, as far as I am concerned, this misunderstanding between me and you is completed.

The sooner I move on, the sooner I can distance myself from this transaction.

So the guy screwed up, your snakes died, you're not getting a refund, but you and Victor are all hunky-dory now? Why are you accepting the fact that you're not getting a refund?
 
Hi. I wouldnt say that Victor and I are "hunky-dory." Im accepting that fact that no matter what is posted here, or what is proved or disproven, will not help me get a refund.
This thread was not a post to threaten Victor into giving me a refund. I acknowledged the fact that I wasnt getting a refund long ago. The reason for posting this thread was to share the facts of this transaction with other potential reptile customers so they can make their own decision about whether or not to purchase from Victor. I did my best to try to present all of the evidence I had in a truthful and respectful manner.
From around the middle of January, up until the date that I started this thread, I did not have any contact with Mr. Rivera. Mr. Rivera contacted me on his own behalf around the middle of last week in an attempt to resolve this situation. I personally was surprised that he called and showed any signs of an attempt to resolve the situation. I was also surprised that he owned up to his mistakes and apologized. True...I didnt get a refund, but Im not going to continue to beat this issue. Out of respect for Mr. Rivera calling me and talking to me in a civil manner, I am no longer posting negative comments about him.
On the phone, Victor personally told me that he did not properly package these snakes and that he should have ensured that the snakes would arrive to me on an overnight basis. He also assured me that these problems will no longer occur with future customers.
I may come across as sounding soft and way too understanding, but out of respect to Victor's comments, I feel that I owe him the benefit of the doubt.
Dont take this the wrong way. Im not sticking up for what he did. Certainly if I were the one that made these mistakes, I would refund the money with no questions asked. That would have been my response to this situation. Unfortunately, every individual acts and reacts in a different manner.
Its not my duty to be the judge of Victor. It is, however, my duty as a decent human being to be able to forgive.
I spent the past 8 years in the automotive industry as a service and parts manager. Both myself and my employees made mistakes every now and then. We did our best to ensure that mistakes were not made, but regardless...they did happen on occasion. I felt that I did my best to resolve these mistakes with the customer. Most of the time, I was able to resolve them to the customer's satisfaction. Unfortunately, sometimes, I was not able to...regardless of what I did. In those instances in which the customer was not satisfied, I always wished that somehow they were a bit more understanding of the situation.
Again....Im not sticking up for Victor, but I am doing my absolute best to treat him the way I would like to be treated if I made a mistake.
I'm not going to forget what Victor did to me, but since he was man enough to call me, speak to me in a polite manner, and listen to my grievances, I decided that I am no longer going to bash him on a public forum. That is all. Im not going to recommend his business to others, but on the other hand, Im not going to go out of my way to make sure that people avoid him.

I've watched this thread, but have stayed out of it in hopes of a resolution for you. I would now like to take this opportunity to personally thank you for allowing at least one negligent, dishonest, demanding, extortionist piece of garbage to know that as long as he is respectful, he can continue to take the money you worked for (I'm sure it was easy in today's economy) and ship you dead snakes. Furthermore, now he knows that insisting upon removing a BOI thread (which he knows is impossible) as a condition to refunding you for snakes he KILLED is also acceptable. Kudos, man, KUDOS!

BTW, can anyone out there in Fauna-land remind me of why there are so many scammers in this hobby? Anyone?
 
This is his MO trying to be nice over the phone procrastinating in hopes that you will just go away and making sure it is done over the phone so there is no evidence since what he says changes from what he said over the phone to what he says in emails. His stories change from day to day.
So he admitted to fault but STILL does not feel it warrants a refund??? I still say any business who cares about there reputation would REFUND especially with all the evidence, and would want to try to care about having a good name. This guy has no back bone and is running a scam artist business. I am sure he has done this time and time again, but since he tries to befriend the people when an error on his part is CLEARLY made, they let him get away with it or dont know what avenues to take to report him.
His day will come. I really hope people think twice before dealing with this jerk!
 
Brian, As much I would like to admire you for wanting to forgive and forget Victor; You have just lost all of all that and more. You have not only taught him that harassment works, but everything crappy thing he has done is OK and that an apology cleans up any of his "mistakes", the first time you do something wrong it could be considered a "mistake", but when you commit the same purposeful action over and over and over...poor shipping, crappy animals, insults and attacks...in order to make profit at the expense of your customers and the welfare of the animals...it is NO LONGER a mistake do you understand this Brian? Nothing he did was a mistake, it was all deliberate and consistent with his prior actions.
Next time you forgive someone for changing their ways, why don't you actually wait to see if they do in fact change their ways first
You are now personally responsible for helping to keep this person in business so another person can be scammed.
