Now before I signed anything with Neil I was told by Neil the following:

~IMO, this is your whole problem. Although you may (or may not) have been TOLD anything by Neil....If any of those things were NOT in the contract then you should NOT have signed it. That is a very simple and basic rule of business. If there was no list of items included in the deal listed in the contract, then they are not part of the deal.

~Just as I learned in nursing, and it applies in every career i can think of..."If it's not documented...it didn't happen" . Did you have a lawyer look over this "contract"? It certainly does not sound like it.

~Sorry, Dave, I do believe you need legal counsel but I don't think it will do you much good in the long run. Good thing for you the first visit/consultation is usually free. They will be telling you the same thing.

~ Actually, you might want to retain that counsul...I have an unshakable feeling you are looking for allies and pointers for a specific reason....like maybe YOU are on the defendant end of this deal?

~Mind If I quote myself? I usually have no problems letting things die out, especially when I am not directly involved. But when a hunch plays out then people who might have been sucked in to this pity-party really deserve to know.

~There are people who like to play games and try to pull sneaky stunts on innocents. They feel like, if they gather some allies before the sh*t hits the proverbial fan, then they can act the innocent victim and these new "friends" will come to their rescue. That doesn't always work and this needs to be one of those times.

~ A little birdie just told me a story that makes alot more sense. It seems a certain someone owes 2 months rent to the landlord of his store and needs to have it paid or he will be put out. Now this same person called the manager of the complex where the BOI-ousted Mr. Gubitz resides to "turn him in". This, too, backfired as this manager and Neil are good friends and she is well aware of his "inventory". Now, why would a person do that if not trying to stir up trouble. So many people find a need to make others look bad in order to make themselves look good.

~But the part I really find interesting is that Mr. Lawson, has in fact, been served and must appear in court on May 13th. He is being sued for a sum of $5000, monies due on a contract he recently signed for Neil's store.

~And the strangest part yet, is that he was served the papers right about when he made the intital post of this thread asking what to do about Neil Gubitz.

So who is your source for all of that info? It's not that I doubt you, but if it's Neil (without any outside corroboration), I would take it all with a gain of salt. Frankly, they've both lied to and about each other so often, I cannot imagine believing anything either of them would have to say!

I can't figure it out

Without taking any sides in this matter (it is difficult to take sides because its hard to figure out who to believe) what I can't understand is why Dave would have wanted to do any kind of business with Neil after what had gone on in the past. It kind of makes me wonder if all off that crap was just made up for our entertainment and they are at it all again. As far as I know Dave has never made any public comments to the fact that he treats this forum like a toy similar to what Neil has, but based on Neils errant email a while back I could see him pulling a stunt like this.

My advice to you Dave is to get a lawyer and settle this. As knowledgeable as many people on this forum are, and as willing as they are to help, sadly there is really nothing any of us can do for you other than offer moral support, and to be quite honest, I am sure there are those out there who are hessitant to offer even that given yours and Neil's history.

~Anyone who knows me well, also knows that I am not one to believe things just at face value. I lived in the Sunshine state for a number of years. I still have family and a number of friends centrally located in the state. It is ever so easy to find out what I want to make sure is true. I am not one to put my head on the block for anyone unless I am sure who is swinging the ax.

The facts are !!!!!!

I started this thread on 3/30/03 Neil filed the papers 1 week later because I would not recant what I had posted. I am not even a little worried about the court date I have a attorney, The contract and witnesses to show that Neil is in the wrong (again). I also have a list of 23 people that have given statements that say that Neil has told them things like he still owns the store to I am selling stolen animals all these people are willing to go to court for me. Neil was also good egough to leave me 4 years of the store records complete with how he scamed the cops, insurance company and the I.R.S..

I am sure that the little birdie that told you this was Neil, All I have to say about that is do not let him lead you down the same path that he travels.

OH, by the way I did not call the apartment complex that he lives in but I am going to make it a point to first thing in the morning and let them know that I had nothing to do with it. But I do know that those apartments are not zoned to let people run a busness out of them.

Wow May 13, Dave and Neil or Neil and Dave in court in Tampa............! Color me there. To actually see both these guys in the same room UNDER OATH and hear what comes out of their mouths will hopefully unravel one of the great mysteries of our time. Are Neil and Dave or Dave and Neil twins sons of different mothers? Just joking, but seriously anyone who is local and has the time should go and watch the proceedings. That way neither one of them can make up a story as to what happend in court. I know i can get the transcripts from the case, but it cost money and it takes awhile before they're availible. I bring this up because of all the warring between the two of them and i think this is the first time they will see each other in court. Hopefully this will put and end to the fighting on the B.O.I. between these two in the future. Ciao. Peace.

If you're really being sued, and you really have a lawyer, keep your mouth shut about it here on the BOI. Crying out loud, man! It's stuff like this that makes you look completely unbelievable! You and Neil have been at each other for who knows how long, and now you start this thread, we all tell you to take it up under legal auspices, Neil brings suit, and you're here telling us all what a big list of witnesses you have?!?!?!? Nobody really cares what either of you think, and we are all just going to have to wait until the dust settles to find out what has really taken place (if then!).

So, my limited advice to you is exactly what a competant attorney would tell you, assuming you had one. Stay off the BOI about this until after your court date!

THE BIG DAY CAME AND WENT

I know that everyone has been waiting to hear the outcome. Well here it is blow by blow, Neil showed up looking like a Don Ho throw back with his flower shirt un bottoned half way and as soon as he saw me he started with his smart mouth with "I'm surprised he had the balls to show" once we entered the court room we sat though about 10 other cases then our names were called Neil .......I guess its GOOBLITZ and David Lawson we sit down and the judge ask me if I admit or deny the aligations set forth by Mr. GOOBLITZ, I denied them. The judge then ask if we were willing to have our case mediated I said "yes" and Neil said "BUT I HAVE A SIGNED CONTRACT" The judge then confirmed are mailing addresses and set it for a final court date. Neil was still saying "But I have a signed contract" over and over. On the way out of the court room Neil went back to the smart mouth saying " LAWSON YOU ARE A JOKE" AND "i WILL GET THE STORE BACK" I then told Mr. GOOBLITZ that I was going to knock him the F%^@ OUT IF HE DID NOT SHUT HIS MOUTH, needless to say I did not hit him but instead talked to the baliffs they took care of the problem.

So nothing happened. We got another court date in oh about 6 to 8 months (the way the courts are he)
