I am responding to the case where the snake died in transit to its new owner.... This is a breach of contract case ( I am not saying that there isn't fraud as well). The buyer paid for the snake in full and the seller sent the snake... contract complete. When the buyer did not get what he was originally buying, that was the breach. He was purchasing a snake of a certain size and weight, and did not get that; therefore he is entitled to FULL reimbursement of payment as well he can sue for any items that were purchased for this particular reptile. It would be easier to sue for breach of contract civilly then to sue for fraud. If I were in this guy's shoes, I would have already began my civil case while I waited for law enforcement to do their investigation and the pending criminal charges (if any develop). As well as full reimbursement, additional items purchased; the civil case would include any attorney fees accrued for representation and paperwork. Its not rocket science to see that the seller of the snake breached his contract with the buyer... the buyer just has to stand up and take a stand and do ALL that is available to get his money back. An attorney is not needed to file a civil suit anyway. A call to your local courthouse will tell you who has jurisdiction over this so you can decide where to file... the paperwork is self explanatory, very simple to complete.
