Correct me if I am wrong, but I think the threads on business started with Corey Kingsbury, then Southern Exotics kicked in, Corey admitted he was lying and perhaps Southern as well. I have not read anywhere that Corey has made good, but Southern and Upstate came to terms.
Very soon after ken came in the picture on the other two tails and said upstate ripped him off as well.
Sheesh what fun trying to keep up with this saga.
This looks like a domino affect to me.
As I see upstate posting proof that is asked of them and as they have saved all invoices and emails and such, I tend to think that they are telling the truth on this one. Perhaps they have learned from the prior deals, either way, they have the ammo needed in this case.
Perhaps the best place to solve this is in a court of law.

Maybe Upstate isn't understanding things here so I will state this as simply as possible:

There was no contract for partnership.
No contract, a judge will not sit through all the convoluded claims because there isn't a piece of paper that is signed by both parties saying either it was or wasn't supposed to be this way.
This means neither of you collects on your claims. You simply chaulk it up to experience and move on.

It doesn't matter if Southern State lied or if Upstate lied or if they both lied or if they both told the truth. You are both at this point because of poor business pratices.

One of you chastizing the other is like an alcoholic pointing at a bum and calling him a drunk.

I have all the documents, plus when the judge asks to see PROOF that ken purchased these animals, there is none....hence this entire problem....

Common sense SAYS it's not supposed to be this way....let me ask you this...you send someone over $5000 worth of animals (all of your good stock, and bring your inventory down to almost nothing)...but you do it, just because.....is that the way it's SUPPOSED to be?

I didn't ask if he had paid for it, I asked if he was in posession of it.
If you are still in possesion of it, he only owes you if he wants the design.
Yes, you are out the time you invested in coming up with the design. That is why you ask for 1/2 down in advance before you even start work.

A judge would look at you and ask why you were wasting his time with no written contract to prove that a "partner" wouldn't send animals to the other "just because". With no contract, you have no definition of who had what responsibility. You have nothing to say this was a "50:50" partnership, a "70:30" partnership etc.

You are correct in saying that there is nothing that says what the partnership consisted of. As for a partnership, there is a verbal contract with evidence (ie... mag advertising, merging of names ect..) that there may be enough for a case.
There is a lot of money involved here, there is a lot of e-mails and shipment invoices as well as where they were sent to.
It is worth a try if they (as in either party) can establish that there was indeed a partnership and a time line and exactly what was owed.
Getting in front of a judge is not the hard part here, in fact very easy, proving all this and having your ducks in a row is the hardest part.
Still say it is worth a try, and better than just sitting behind a computer going back and forth on the BOI.
