I say take it to the news if nothing has happened yet. The Mayor knew from the beginning that is was the animal control officer's son. And if he his letting an employee'e son break the law who else is the mayor letting break the law that is connected to the city and they will jump on it big time he is not a popular figure in the city right now

Well, as to small claims court, I believe it would fall under the jurisdiction of Erie County Court, and not the city of Lackawanna court.

I have had to file a small claims suit before, but it was in Rochester (Monroe county) and not Buffalo.

The way it worked for me was that I had to personally be AT court. The company I sued did not show up so I by default won the case. However, the company had debtors in line "before" me, so I got nothing from it even though I won.

If you cannot personally attend, you may have to have a lawyer show up for you. If I were you, I'd contact the New York State police and ask what you should do in this case. Also, there was an Internet Fraud organization - file a complaint there as well.

Give a call to the phone number listed on the link I posted above and see if they can help you with a remote claim. The claim fee is small ($10 or $15). You have better luck getting results when filing a claim against an individual person than I had suing a company that was going out of business, since the individual person can't "escape" from their own name.

I'd avoid calling Lackawanna city police or the mayor's office at this point. It sounds like they've "closed ranks" to protect their employee from what they wrote to you.

I am assuming this is the same guy. The SPCA return address label adds support that the seller in question is the animal control officer in Lackawanna. Interested to know if your caiman was originally someones confiscated or abondoned pet. I am sure his superiors would love to hear that he is shipping caimans USPS Priority Mail.

The Erie County SPCA is aware of this thread and problem with the whole family and their "treatment" of animals.

His father will be going to court on January 6th 2009 in West Seneca for killing the cats.

The court time is 8pm if any WNY resident wants to attend.

When searching for information on his father who is going to court next month for KILLING CATS and also not returning animals caught in Lackawanna NY to the SPCA of Erie County, this thread came up under "Fred Grasso" and "grasso lackawanna".

It's coincidental that this family has TWO ISSUES with animals with a father and a son.

Most likely this information regarding the family will be used in court since Barbara Carr of the SPCA is aware of this issue, the thread and has the photos of what happened to the animals after being sent.

Were those lizards something the father confiscated and then gave to his son to sell on the 'net?

This court case will be interesting.

If you are in Western NY, please attend his court date and protest the fact that he is still on the job after shooting some cats and a family dog.

Did the person who received the package call the SPCA of Erie County when the animals arrived dead? These may have been a purchase but this was a living creature.

This whole scenario should have been reported to them instead of just going to small claims court.

Your news is terrific as far as I am concerned. Though I have no dog in this hunt I am always happy to hear that a dirt bag is being called to task for their crimes.
Were I in driving distance, even for a day trip, I would love to be there just to see it happen but Colorado is just a little to far away.

Bart Sharrah is Grasso's son? Am I reading this right? I'm asking because I once had an argument with Bart about him illegally collecting a North American Wood turtle in PA and selling it. If I recall correctly, his argument was that he did nothing wrong by selling a native species because it was being sold with a complete habitat setup. I argued that he was knowingly circumventing the law. Other members here supported my argument I believe but I don't recall who. I think the thread is probably still here somewhere if you care to search for it.

Well, if this is in fact the case, then the apple doesn't fall far from the tree, and it all makes perfect sense now.

Selling a protected species in an area where it's illegal to sell them... It seems like exactly what he made it out to be.

Grasso Accused of Killing Mother Cat and Two Kittens

Last night, the Honorable Richard B. Scott set February 9 as the trial date in the animal cruelty case of Lackawanna Animal Control Officer Frederick S. Grasso. The trial will be held in West Seneca Town Court, 1250 Union Road. Times will be announced at a later date.

In June of 2008, Grasso was charged by the SPCA Serving Erie County with aggravated animal cruelty after receiving multiple reports from witnesses that Grasso shot and killed one mother cat and two of her kittens. The alleged killing took place in the community basement of an occupied apartment building located at 93 Eagan Drive in Lackawanna.

Grasso appeared in West Seneca Town Court last night with SPCA Special Agent Charles Braun, who charged Grasso in June after an investigation into the animal cruelty complaints. Although Grasso was not arrested or formally charged at the time he allegedly told Braun that he killed the cats, his defense attorney believes Grasso should have been read his Miranda rights. Judge Scott has given the attorney one week to submit case law on why he believes Miranda rights were necessary before he issues a ruling.
