Most breeders offer a health guarantee for a short amount of time, but the sex should be covered for as long as it takes. Not everyone can sex a snake, especially if it's small. If you sell something as a female, it should be a female. If the person can prove it's the same snake, there should not be an issue with refunding for the incorrect sex.
Actually, MOST breeders/wholesalers offer a sex guarantee only for a limited time. Most of them will tell you it is the buyers responsibility to sex the snake upon arrival. It should be common practice to remove the snake(s) from shipping container, visually check over to ensure there health, document all your notes, sex snake or have it sexed and take pictures of snake, container etc.
