In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

Yeah, I know. They are a pain in the butt. But they pay the bills to keep my server running. Just a fact of life, I am afraid.

Want to get rid of them? Simple. Just become a Contributor level member or above and they will be gone. -> Please click HERE."

Is that too much for me to ask of you to keep this site running? Well, sorry about that. I too wish I could get everything for free. But alas.....

    =====================

Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Jodi Aherns ~ Poor Business ethics and poor shipping methods!! AVOID

I'm not sure what you are saying but you have misconstrued my meaning. Read the post again.

By the way, how many reptiles have you shipped?

I meant to use in quote forum... Well I am not really on either side of the "DOA Debate" I thought I would point out something.. Jim when you said that "I can just ignore the door bell and have the UPS guy redeliver the next morning DOA for a full refund" That could happen, but why would someone want there money back and no animals? It can go both ways. The shipper could decide to ship dead animals and take off with the buyers money.. :bolt01: So it can go either way.. It is not just the seller that is taking the risk...
I had this happen to me and thats why I have it in my Tos if your not there to accept the package Then it is the buyers responsibility but I do understand Chit Jumps up But unless I'm notified prior to delivery your out of luck but I do bend to accommodate people thats my down fall :)

Just let it end.Matt will get his full refund of $135.00.I made a mistake.
I agree If we want to talk about The rights and wrong about the shipping = TOS's start another thread somewhere In the other Forums Matt & Jodi I'm happy to see this was worked out and sorry for the Hijacking of this thread :)

Jon negligence by the buyer doesn't offer them protection.

Jim the laws for each state, and the buying of goods and services from other states are well laid out, Like I said take a look. I'm not going to check each states laws and codes for you. There have been laws on the interstate buying and selling of animals-Pets and Livestock for a long time. As it has been brought up in this thread and one other I know of ,TOS are only binding if they abide by the law. As for a live arrival guarantee ? well it would depend again on the laws of the state.

I've been in the animal business a lot of years and we've had the documents used in the selling, leasing, breeding ETC ETC of our animals draw up by attorneys so we are protected. Randy

Randy,

This is where you should perhaps leave law to the lawyers and not pretend to have a clue as to what you don't know. Interstate commerce is the exclusive province of the federal government and state laws are trumped by them 100% of the time. In fact, it is one of the few prerogatives of the federal government as defined in the constitution of the United States. Now you keep saying it's well defined. Show me statute and don't cop out by saying you aren't going to look it up for me. You are so certain, show the source or you're only blowing so much hot air. Your experience with cattle and horses is hardly relevant to exotic, non-domesticated animals, which all reptiles are. Like I said, show me the law which says that I cannot waive my right to live arrival by agreeing to someone else's TOS. If you can I will believe it, until then, I believe that it is a simple matter of contracting concerning who is responsible for an item and can be negotiated and agreed to between buyer and seller like virtually any other matter.

Gee Jim, you certainly don't :dancer01: around and blow hot air do ya?

I was told when looking into this matter a couple months ago that upon a buyer accepting my TOS and sending payment that we were then entering into a legal contract. Much past that, the individual state laws were not an issue due to that contract being in place. Unless, I entered into a contract with a minor who did not have the parents permission. Or the animals were being bought and sold illegally in my state.

Not like I would ever go to court but I was told that the contract would hold up as long as I could provide proof of payment and delivery. And also that all the terms were clearly written and there was no "dark areas" that could be twisted around due to a persons perception. The key I was told was to be very specific and outline everything clearly.

I may have been completely misinformed but I only went by what I was told.

doesn't suprise me

considering a year ago he sold me 1.1 g areanus supposed cb and proven breeders $360 worth in trade and i got two wc parasite infected wc's ........ i was in contact with jodi via phone and kelli hammack. the first time kelli saw them she told me those arent CB they were skinny, skinny skinny... hip bones showing spine protruding. kelli said they are actually very easy to keep as jodi had said... nothing i did worked even deworming the female died and i gave away the male to some people whom worked with the areanus.... not one time did jodi offer a refund to to send back the leos i sent him and me send back the areanus NOT ONE SINGLE TIME. because hey he got some amazing leos cbb and healthy. why would he???
anywho thats my imput this was about a year ago and all my emails are lost on my broken PC but if one of you would like (when the time is better) just ask kelli

ok btw kelli saw them the day they arrived...

Thats a very open ended comment Robin. Could you contact these other people that he was underhanded with and have them post their experiences? That way we can all be clear on what your referring to with your statements.

Like RebelDragons said, if you can have the others post there experiences that would help out alot..

some will have to post as they see fit... the other has allot more important other things on their plates ... but it is concerning HIS line of bell albinos... i can't speak for anyone nor will i

oh also all you jodi fans well go ahead and bash me slander me umm poke me in the eye whatever i dont care not here at least not anymore but i felt that others should know exactly what his morals and ethics really are....

Robin, of you have something to say about his Bell albinos say it.

Robin brought up another problem she had with Jodi awhile back. She also mentioned a few other problems that other people had... Jim_O wants her to explain the problems. That's all you missed :)
