It would all be different if he hadn't already told me this 3 times. So your telling me if it was the other way around and if you paid for snakes and some says oh they will be there one day and they don't show and then the next TWO times they don't do it again. That you would say oh it's ok I will wait another week and not just want to rework the deal. Or how about you sold something and they didn't pay three times when they were supposed to. When you have the opportunity to take it else where and sell it and get the money FOR SURE you wouldn't want it back. You would really trust someone that has lied to you Three times already. If so you must be a chump.

you're comparing apples to oranges. All of my deals are worked out with written agreements, and documentation. I've never had a deal go bad, because of this. Also, I've never had an animal escape, let alone one that was supposed to go to someone in a trade/sale (want to make sure this doesn't sound in anyway like I'm chastising the child, but I do think you should find a way to lock your cages so a 3 year old can't access them. I mean, can't they bite and do damage?!?!). Also, IF that were to have happened, I wouldn't assume anything... I would search and search and search. If a dog/cat, anything had gotten it, there would be SOMETHING to show for it, blood, scales, toes, a head, etc. So I would have continued to search, but that's just me. I treat every animal that comes in as a pet, and don't buy in wholesale for resale.

So, no, I've never had a situation to be made a chump of, or made a chump of anyone else, and I've done several trades as well as sales and buys.

It doesn't matter WHAT the original deal was, he AGREED to the new deal. He AGREED to send $75 on THAT friday, and then bailed. He agreed to send the money on a different day, and then bailed again. BUt now he'll pay on friday.. so he's the good guy?

It also doesn't matter if there's a show this weekend or not, he was owed the money when the deal said it would be. It doesn't matter what he has to take to the show other than the tegu or the missing tegu or 400 tegus. The guy agreed to pay that $75 on that day.. and he did not. He made new arrangements to pay on a later day.. and he did not. Now he says he'll pay the $75 this friday... will he?

You're obviously missing the point that the guy AGREED to the new deal, and was offered THREE deals, including negating the entire deal, sending his snakes back.

How long does he have to not pay before it's HIS fault he isn't paying the money he owes?

Theresa, that part is in contension. Tim says that he was to be paid last Friday (three days ago), Joseph says he agreed to pay this coming Friday, the 14th. So, unless either can provide proof as to either day, I'm inclined not to factor that into the equation

Basically, I just shouldn't have shipped without payment. By the email you can see he didn't expect me to and was excited when I did. I guess that should have been a red flag I guess, but it was too late they were on there way. I have learned a valuable lesson. I just figured any decent person would be willing to work something out like I did. I guess not. As for you Katie I know not to sell to you because you think it's OK to pay whenever not when agreed upon. Do your utilities get cut off often?

Here's some thoughts from someone watching who does not know either party involved...

Tim...you are absolutely right that you are owed $75, given the details shared here so far. Joseph doesn't even dispute that. He doesn't say he won't pay....he just can't pay right this second, for whatever reason.

My question to you, Tim...is being "right" and a grand sum of $75 worth trashing your own reputation over? You may be"right"...but the impression you're giving of yourself to those like me who are watching is that of a spoiled little child stomping his foot and screaming "It's not fair! It's just not fair!!"

Well...duh. What in life IS fair? Is $75 really worth such a public tantrum? Especially when a little patience will most likely get you your money anyhow. Why is it so hard to be patient for such a small (relatively speaking) amount of money? As has already been pointed out...if the original tegu had not been lost, you'd never have had that $75 coming your way anyhow. So how can you be counting on it so desperately now?

Seriously...just looking at this from a practical stand point and analyzing who I might want to do business with...I'd go out of my way to avoid you. If the success of your table at a show depends on a mere $75 being delivered to you right now, then you're in the wrong business to begin with. I see no business sense, poor organizational skills, and no tolerance for others being the least bit slow or unresponsive.

Yes, you're RIGHT that you are owed $75. But is that worth the impression you're giving to people like me?

I don't see a temper tantrum at all. I have been cool and collected. I don't care if $75 is not a lot to you but my family could eat off it for a week. I don't know your situation nor do you know mine. Every penny counts when you have a family. I got yelled at for agreeing to this from my GF and look she was right. He assured me that's why I sent out before he paid. I learned my lesson and I really don't see how I look bad here. I have went out of my way for him. My kid let the thing loose because I had it in a treatment tub away from my collection and I was going to take pics for him when I got home. I just ran to the store. You can see how long it took to write him. I looked all day. I told him that I would send the red if I didn't find the other one so he could get his tegus the next day. I have done everything in my power but say screw it have a free tegu. But tell me why he deserves that. He has not once tried to work out things with me. I even waited in the beginning with money tied up and I didn't complain then.

No, my utilities never get cut off. My bills are set up on automatic bill pay I have people that have extended me credit for animals in the past worth large sums of money with statements such as "you're the LAST person I worry about getting paid from." I'm fortunate enough to be able to keep the collection I do comfortably. I keep 160 plus snakes. Boas, retics, burms, ball pythons, corns, carpets, bloods, atbs, and others here and there... so yeah, I don't really risk my utilities failing on me, ya know?

yes, as stated here in this post, I will admit, I have been corrected. That said, all I can say is that Joseph has stated Friday will be the date he can pay the $75, and all you can do is hope that he does at this point.

I haven't suggested that you say "screw it" and give him a free tegu. Not in the least. He owes you $75, and I expect him to pay it. Could he turn into one of those dead-beats who says they'll pay for weeks and weeks on end, but never do? He might...I have no idea. But since you're in a position of having to wait, regardless of what your wishes are in this situation....then maybe you could try waiting with a little more aplomb.

That's all I'm trying to say. I realize you DON'T see the tantrum in your words...that's why I wanted to take the time to type all that out and point it out to you. You may feel like you're being perfectly reasonable....but to most of us reading this, you don't LOOK like you are. And that makes a difference (sometimes a HUGE difference) to your future business.

As you can see I was fine with waiting. Until it went from 2 to 3 to 4 to 9 days until I get paid. Like I said I will wait because I have no choice at this point but, I don't think it's fine now. And of course I am going to complain about it. As for the thread I think it has served it's purpose of showing people what to expect and to get payments up front ALWAYS from him. If someone says I'll have it when I get paid it means they WILL have the extra money then.If you don't have it you don't have it. So, why not just send it back is all I was saying. But as I said before I will wait because I have to. And if he doesn't pay he we will be again......

You came across hasty, and rather rude about the whole situation, and as I saw it, unwilling to even admit that you might have had any fault at all. Does Joseph owe you the $75? Absolutely! But only because he agreed to it. I would have waived it, and just called it a wash.

I'm sorry if I implied you didn't care for the animals. It seemed you were in such a rush to get animals in just to put them right on a table, that I worry you would be unable to see the subtle signs an animal would show if it was ill or in need of additional care. I wasn't intending to bash you. I was intending to try and shed light on the other side of the coin. I was playing devils advocate, as it generally helps to see both sides of the situation when attempting to reach a resolution. That said, when you started making statements that sounded like Joseph was lucky to have received animals at all, after you had his animals, that's when I did change roles a bit. Imagine if you had sent your animals first. Two tegus for three pythons. Your tegus arrive in (insert city here) and upon arrival, you find out one of the snakes dies. You're given many options, all of which are probably okay, but you're still going to be a bit disappointed that you aren't getting the deal you originally agreed upon, and now it's too late to renegotiate completely, as your animals are gone. So, even if you decide on something, you only have a few hours to decide, and you can't really predict the full extent of that decision always. Just a hypothetical. I don't know. I've never been in a situation just like this. I just didn't like some of the tones, where I felt you were completely wanting us to disregard the missing tegu, and only wanting us to see the new deal as a "bonus" to Joseph and what a good thing you were doing for him...

I think you're a little off here. I do see your point here, but jsoldier shipped his snakes first. You then had to "reconstruct" the deal that didn't originally involve cash. True he shouldn't have put a time on the money if he couldn't come through, but that's like putting a boi thread on you because you changed the deal due to losing the b&w.

I can't say it was wrong or right, but I think you jumped the guy on the BOI.

I would say as I always do. Things happen and work something out that's how I am. I just don't see how he gets to decide what happens and I have no input. I admit the lost tegu was my fault that's why I offered the deals. I just don't see anything from his side to better things. He just keeps putting me off on the money. So, Of course I got mad after three times in a row. I just don't see how I have to be the one out on the deal. Like I said he could have waited one more day and go another B&W. I waited longer than that for his snakes. I waited around for them all day because he wouldn't even contact me. Then the next night says oh I called them and they have my package and say they wont ship snakes. You all know as well as I do he was lying. For one it's like he put LIVE SNAKES on the box. On top of that they would have not let him leave the building if they weren't going to ship it and even then they would have called to say you package is undeliverable come get it. I've had that happen when my box busted in the hub.I went up there and got it and shipped the next day in a new box. I didn't even say anything about that because I guessed he figured it would sound better if he said it was there fault he couldn't ship that day.Oh and UPS was still open at the time I talked to him. He said the other UPS store was too far and he couldn't make it in time. SO, again I say how was I in the wrong.(a side from the tegu getting loose.)

That's what BOI is for. To let people know when things don't go right in a sell. I told him 2 times I wouldn't start the thread if he would just work with me.But he refused. He wouldn't even respond look at my emails. You also know if a bad thread is stared about you and you make things right people will see that also. It just shows a learning experience. But if they don't try to even compromise a little obviously they're not good people to deal with. I have bought from people with bad BOI threads, but only if they even attempt to make things right. Also, If they have pretty much all good threads after that. I some people just don't get a long. That isn't the case here. I have tried to work this out for BOTH of us. This was a trade so we are both the vendors and the customers here. I tried several times to work this out without coming here. And I will tell you if I get my money Friday I will feel it was due to this thread and nothing else. He obviously couldn't do it with me asking personally.

He has told us both he works alot and long hours, I understood that. If it were me, and I lost his tegu, I'd be very embarrassed and have to offer him what he has now and eat the $75 you feel he owes you.

It just seems you are demanding and rather pushy. And yes as others have mentioned "throwing a little fit" like a child not getting their way.

I just don't see how you feel you are getting ripped off or losing alot of money, or even think he is scamming you ect.. He admitted to it and said he was wrong ect. It's not like he is saying F**k off dude I'm not sending your money. If he don't have it well then he just don't.

You have 3 snakes, he has 2 lizards I'd just call it even and go on..

And I still don't understand why you think bringing this here will make/force him PAY you faster or pay you at all.. Are we supposed to go smack his boss and make him give the guy his check any faster lol?
