In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

Yeah, I know. They are a pain in the butt. But they pay the bills to keep my server running. Just a fact of life, I am afraid.

Want to get rid of them? Simple. Just become a Contributor level member or above and they will be gone. -> Please click HERE."

Is that too much for me to ask of you to keep this site running? Well, sorry about that. I too wish I could get everything for free. But alas.....

    =====================

Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Neil Gubitz (Good Guy)

Folks.... I don't know how to explain this any clearer??.... Linda is absolutely correct in everything she has said.... BUT.... In this life, there will ALWAYS be people that don't like you or don't want to do business with you for one reason or another.... it's inevitable!.... I m NOT looking to be liked by EVERYBODY (it would be nice, but there's no chance).... I'll say it AGAIN!!!.... IN THIS PARTICULAR CASE, IN THIS PARTICULAR CASE, IN THIS PARTICULAR CASE.... did I make that clear enough??.... I was very willing to work with Davey until he was HAPPY.... and, as a result, if that meant giving him a full refund (INCLUDING HIS SHIPPING), that's what would have happened.... but.... THE SECOND HE POSTED THIS THREAD BEFORE OUR DISCUSSIONS WERE OVER.... He blew it!.... I really don't care how much all of you expect me to refund him.... I WON'T DO IT!!.... If you want to get technical.... my written 24-hour guarantee had elapsed, in my effort to WORK THIS OUT, I got sandbagged!.... I won't lift a finger to help someone like that.... there was NO REASON for him to post this AT THAT TIME!!!.... As far as I'm concerned.... IN THIS PARTICULAR CASE!!!.... He OWNS an admittedly MISTAKENLY-SEXED Male Boa.... I'm sure there will be some of you out there who think I am totally out of line.... but, I expect that....
I don't know how I can say it any clearer.... If you want to try and work something out with me.... it STAYS between you and me.... if it goes any further than that, before we have a resolution.... TOUGH.... I'M OUT OF IT!.... This is PRINCIPLE with me!!.... And, I will NEVER change!....

But, Seamus.... I am truly sorry you had to get in the middle of this.... that was NOT my intention.... thank Davey for these problems.... one more email, and he would have been raving about me again.... he just couldn't wait.... with dire results!

....Neil

Give the man a full refund.

I rarely comment here, but have followed this thread daily. I feel that if Neil sold as a female and Dave has proof that it was a male then 24 hour guarantee should not count. The animal was said to be very nice and healthy, but thought to be a female. He has shown a vet report showing male.

I think that everyone here is spending their time over interpreting he said she said stuff when it seems to me to be very simple. I would give Dave a full refund and get the snake back. Check the snake again and then sell he/she online once more. You may lose a few dollars, but it is not worth all of this drama.

It seems to me that Dave is a nice guy and may not have known how to react to the shock of it being something it wasn't. Also, how things are said or worded may make the difference in if a person is offended or not. How you speak to someone on the phone or especially how a person types an e-mail really does matter as to how people perceive the situation.
Anyway, those are my thoughts.
thanks
Bruce Davis

I too think posting on the BOI was not a good idea untill no agreement could be made.

I just had a problem that was ALOT more severe and alot more money was involved, BUT, me and the seller have been in contact to date. Even though im not 100% happy with the transaction I had, I didnt bring it to the BOI prematurely ( was already solved). If that is the case here (appears to be) I would understand Neils side. I also have not read where we are positive of the gender.

If I were the buyer in this situation, I would have shipped the animal back to be probed by a cert vet of Niels choice, AND THEN asked for refund if it was indeed a male.

If a buyer didnt tell me he wanted a refund on a mis-sexed animal, then came here before we resolved it, I would not be very happy either.

Im not saying Niel is right, or that Dave is right, I know if this was my transaction, it would have been handled alot differently. And if my 24 garauntee expired and the buyer got on my nerves I would not offer anything further.

With all of this said, I dont know that a refund is just, I might go ahead and give one on the snakes return , just to squash this mess. But that would be up to these two to handle it.

Never once did I ask for anything back. nor am I going to do so now. Had I found this "mistake" before the 24 hour period was up then yes, I would have contacted Neil and asked for a refund.I did not however and that was my bad,I am eating the cost, no biggie. I didn't post here bacause I want anything back. I posted here to share my experience. From the get-go I was "wrong". It was like there was no way in hell that snake was a male. No way.Well, it cost me $38 dollars to prove it, but I did it. So, if i had taken Neils offer of $50 I could be on my way to the candy store with a whopping 12 bucks in my pocket. Would that have made any of you happy? Getting a $12 refund on a snake that was 3/4 the length you ordered, and the wrong sex? I doubt it, but I could be wrong again.
I would like to say that Neil does ship well, has great looking animals, and after the sale and a post on the BOI he does do what it takes to make the customer happy.
I wish this hadn't turned into what it did. The BOI is to inquire and learn or share experiences, and that is what I did. With threads like this though it is no wonder why people have a hard time finding that info. I don't have anything against Neil, and as long as my money is good with him I will probably not hesitate to order from him in the future. I do wish that he would have been more open to the idea that he had made a mistake. He did say that the size was a misprint, but has never once said that it was even romotely possible that it was a male, and would not believe me until i proved it.
It's funny kinda. I trusted him enough to to send him the cash for a 4 ft. female, and got a 3 ft. male, but didnt get the same trust.I didn't send him 3/4 of the money , nor did i send in another countries currency, and yet I was the one who couldn't possibly be right .
I don't have anything else to ad at this time, and I am sorry for taking up so much space on the BOI.
Good luck Neil with everything, but please be more open to the possibility that others may be right. I know that is hard after everything that you have been through from the begining, but not everyone is a crook or a scam artist.I was just a misinformed and unhappy customer. This was never a case of buyers remorse, just felt like I got exactly what I didnt order.

One last thing I forgot to address since people are still ranting about it. I don't think I posted prematurely. I did post my good guy post before it was probed, and didn't feel comfortable leaving my name on a list of people who loved how their transactions went.I was told that the post could not be removed, but that I would have to write a new post retracting my post. That is what I did.

sorry

I missed the vet report that stated it was infact a male.

THE SECOND HE POSTED THIS THREAD BEFORE OUR DISCUSSIONS WERE OVER.... He blew it!.... I really don't care how much all of you expect me to refund him.... I WON'T DO IT!!....

I would be upset as well.

Its great that you are not to sour about this, and its enlightening to see your not bad mouthing because of someone elses mix up. whether or not you got burned, I would have to say Im impressed with your attitude after this.

Dave,

I empathize with your plight completely.
I would be upset as well if I didn't get what I thought I was buying. I still think if you wanted a refund it should be open to you.
I, however, do still think you jumped the gun on the BOI. No matter what you were told you could have tryed to resolve it in private, then posted that the transaction did not go well but it was resolved.
This looks like principal on both sides but still no one is happy. I hope Neil does offer the money back and you take it and get what you really wanted and Neil can re-sell his snake.
Hope this turns out better than this.

Thank you Al, this never was a bad guy post. This was a retraction of a good guy post. Negative one plus one equals 0.So as far as I see it we are where we started from.
The reason I posted was just get my experience out there.
When would have been the time to post? A year from now when I sell the snake as a female, and the buyer contacts me about it being a male? I mean really I had no reason to sex it anyway right? It was sold as a female, after being sexed by four people who all said it was female. I wouldn't even have known until I went to breed them if I hadn't taken the snake to show off.

I will never ask or even suggest that Neil refund my money. I am happy enough knowing that he did offer in earlier posts. I have a lot of respect for Neil not going against his policy of 24 hours. I never thought that he would go against that, and never expected him to. This post isn't about anything that happened after I posted, this post is about the transaction that originally took place. a snake that I recieved vs. the snake that I ordered...nothing more than that.

Linda,
You have some valid points, but I still see that it was not handled correctly. If I send out a mis-sexed snake, my first reaction would be complete refund and embarrasement on my part. If I felt weird about it I would try and find someone in his area that I trusted to sex it. Is it common courtesy to tell your customer why he purchased a snake? That he was not looking for a female. Is it normal to have to argue with your reasoning for purchasing a missexed animal before you can even talk about refund? Also, the qoute you used "What do you want me to do NOW???" If you read the sentences around it, it doesnt sound like he was willing to really work it out. But this is all he said she said and open for interpretation. Davey knew his 24 hour guarantee was over so that is why he did not expect anything. Why is his post premature? I personally wouldnt have posted so soon, but would it not be the correct thing to do to inform other consumers of something like this. He posted just as quick when he thought it was a good deal. I dont think the mentioning of your name on the BOI is necessarily a reason to make anything youve done null and void. I also think that it makes novice keepers have to think twice about purchasing from someone who they know that they have to get it to a vet or to an experienced herper for sexing immediately upon arrival. I think most Professional Breeders of Ball Pythons would guarantee the sex of the animal sold. I know I will when I am ready to sell my babies. I also think that if inquiring or posting, anything other than positive comments on the BOI, will null and void any possible negotiations or dealings you might have, you should also place that in your guarantee.
Im in no way out to attack anyone personally, but the correct sexing of the animals is something that is very important to me and should be represented (wether intentional or not) correctly. I'm surprised others dont see it this way, but this is a place where we can hear everyones ideas. I hope they resolve this, but it sounds like Davey is pretty cool about it, and Neil is sticking to his guns, so it is already solved.
Thanks, Tom Baker

You may not have jumped the gun, IF you had already decided to keep the snake. This thread was such a mess, and I must have read some details wrong, and I thought you were looking for a refund.

I have about 10-15 unsexed snakes that go back as far as 8 months, and I too would be at a loss if they were in fact the wrong sex.

If your transaction was in fact done in your eyes, then you post about the wrong sex would not really have been too early.

Like every other story, this one has two sides as well, and its good to see it worked out even though both parties are not perfectly happy. I know I will learn from this as most (90%) of the snakes I buy are to be females.

Good luck with him by the way,

A Hypothetical:
I go to a restaurant and eat the best meal I have ever had. The food is great, service is great, I am in heaven. When I go home I jump on the phone and call everyone I know and tell them about the restaurant and tell them they should try it because they will not be dissapointed.
Later that night I come down with food poisoning and I call the restaurant and they offer me a free meal next time I go.
Do I not call all of my friends that I gave such high marks to the restaurant to?Just take my free meal and leave it at that, knowing that they could very well get sick when they eat there?
How long do I wait before letting everyone know?

I posted the good guy post fast, and I retracted just as fast, nothing premature, as it is all relative.

Just an observation but Neil, it appears you take praise on here very, very well. I would even say you take it better than anyone else. But when it is anything other than praise, you fly off the handle at the mere hint of anything negative whether it is constructive criticism or a legitimate complaint.

Goody Guy???

I know this is a little late, but I seriously must contridict Neil

Now he says popping a snake under a year old is dangerous, after the 1st few months it becomes dangerous. This neil character might be a good salesman, and a reliable honest guy, I cant talk about that, because I havent bought from him. But he's going against people a lot more than him. With his statement "popping under 1yr is dangerous". Well my friends, as Tracy and Dave Barker, phillipe de Vosjoli, and Roger Klingenberg. And I quote all four of them in saying "...can be sexed with certainty using the popping method ONLY during the first few weeks after hatching. After that young males gain sufficiet muscle control of their hemipenises to render sex indentifaction uncertain." As you see folks, you can trust Neils knowledge, which may be very right in many cases, but not this instance. So he's right or those four, widely known and respected people are. Take your pick.

Davey.... Originally, I was very upset that you posted this BEFORE we completed our "talks", and THAT was my ONLY PROBLEM!!.... It had nothing to do with ME being WRONG about the sex, or ME MISTAKINGLY advertising HIM as 4' instead of his REAL 3'.... I have to say, though, the way you are handling this fiasco AFTER you read my last post.... that shows A LOT of class.... with that said.... IN THIS PARTICULAR INSTANCE.... I would like to RE-OFFER you a FULL REFUND, INCLUDING YOUR SHIPPING AND VET BILL!!.... I would have done that in the first place, had you NOT posted.... I have to say.... I wish I had as much self-control as you do.... but, alas, I don't.... it takes me a while to calm down (2-3 Midols, usually).... lol
Just send the MALE back, and as soon as I get it, you will get your PayPal, or any other way you want your money.... email me PRIVATELY and I'll give you MY UPS # to ship with.... I've got to admit.... you've certainly showed me how an ADULT "should" act....
My apology....

....Neil

Credit where credit is due. Well said Neil. ;)

Well, it seems as though this is winding down, and when I have talked to Neil we can go from there. One last thing though, Neil, if you ever get ahold of a female that looks like this male, I better be the first to know. Thanks to all who replied, it seems as though we all learned something from this thread, and we will all grow from this experience.
best wishes to all.
Dave
