Refund Given

I did receive my refund in full for PayPal payment send to Shannon Davis on April 25, 2005 for colorless dragons I received from Mitch Triana or whoever he is in Miami Florida. In my last post I said give me a refund and be done with me. I have received my funds and I will not give any further opinions on this transaction although I do have them. A big thank you everyone who was involved in getting me my money back. I have learned to be careful who you buy from and next time I buy a dragon via the net, I will have a home phone number and verified address for the shipper. I learned a big lesson and thank's to all of you not an expensive one.

Tracey, please email me so we can write up a memo to say that if these lizards were not what you were promised, and were not as advertised, and you have been asking for return and refund and have been ignored, that you should be able to charge boarding fees for keeping them.

In the interests of justice, I would appreciate if any beardie breeders reading this thread please email me and tell me the going rate for beardie boarding fees. I think that since this matter has, through no fault of Tracey's, taken much time, she deserves adequate compensation for taking care of these lizards. I would venture a guess of $5/day per lizard, up until the day she actually received her refund.

Jimmy what claim do you have to those 2 babies? You are out no dragons and you are out none of YOUR money. You have zero loss!!! Well nothing more than your reputation..........

You have no right to demand those dragons from her. Making that claim with an ultimatum is asinine.

That is unless those 2 dragons were YOURS to begin with. That would explain why your demanding them back.

Jimmy, those were not your dragons. Or were they???? You are out exactly $0.00. How are you entitled to return of the dragons that she bought from Frank/Mitch? Unless you are in business with Mitch and are part of this entire SCAM. But wait, you told us you had nothing to do with it. The money just showed up in your account. You are sounding more and more like a SCAMMER Jimmy. I am so shocked!!

If Frank/Mitch wants their animals back, then they can request them. Maybe they want to pay their fines and post something here explaining how it is that Jimmy is entitled to these dragons.

Lucille, I have only boarded a few dragons(5) for a friend of mine as a favor one time. They went away for a 2 week vacation and said they would cover all the costs for the food and supplies. They were very generous and gave me $150.00 for the 2 weeks. I tried to deny it but they insisted and said $150 for food, electric, time, and stuff like that was fair in their opinion. Sooooooooo going by that I would say Tracey has had the 2 dragons for 30+ days so I would say $200.00 - $300.00???

I was sold two red female dragons and was shipped two colorless normal dragons. When I complained I was told they were in a shed, stress, cold (they were shipped to Maine with NO heat pack). I was told I could get my money back, but whe I asked for a shipped address, the correspondence stopped. I paid a Shannon Davis for these dragons using PayPal. Funny, she lives in Texas and he lives in Miami.

Here is my take - I think they are one in the same. I think Jimmy = Mitch, either that or they are running a VERY close business. JNSDragons has shown multiple times here that they are a lot closer aquainted to Mitch then they claimed to be. The whole ordeal of Mitch scamming someone and paying Jimmy doesnt make sense, nor does Jimmy's claim to own the dragons, unless of course, as Mike (rebel Dragons) said that Jimmy sent the dragons in the first place. Mitch has faked his identity and name before, why not fake your name AND location?

And because Jimmy is claiming ownership (after the refund) of the dragons, Lucille, you can still bill him, in all seriousness.

OK Jimmy, here's the deal: I do not think you have ownership rights in those dragons, and I can't wait to hear how you are going to explain that you do. HOWEVER, if you claim right to them, the fee to be paid for boarding PRIOR TO THEIR RETURN is $300. When I hear from Tracey that she has received those funds to compensate her for her time, then we will process the return.


Want to take it further? I can't wait, buddy. I will be there with Tracey, this thread in hand, to explain to the judge EXACTLY what happened to her, a poor single mom who just wanted to buy a lizard or two.....

Mitch purchased a dragon from me and it also went through Shannon's paypal.I have spoken to two other people recently that also dealt with Mitch and once again, it went through Shannon's paypal.I don't know why Jimmy and Shannon continue to deny their relationship with Mitch.It's obvious that they are still in contact with one another and still trying to screw people over.Mitch's reputation is totally shot to hell and I think that Jimmy and Shannon are not to far behind if they continue on this path.

2. You had an angle in this from the beginning and were helping Mitch in his scams.

I am just completely fed up with this Mitch/JNS situation. I at this point have zero doubt that that JNS and Mitch have been working together for some time. The evidence presented by all these people leaves little doubt.

Jimmy has done nothing but dig JNS a deeper whole in every post he has made. The lies, inconsistencies and general BS have compounded to the point that he can't keep up and remember all the lies he has told.

I would stay silent too. But then again it's hard to be heard from 50 feet down a well. I wonder if you have one single person to call a rescue crew for ya...............So far no one has come to your defence. And many others included myself that once defended you have now seen "the light".

Such a shame too, business destroyed, names dirt, and a tainted image all for a few extra $$$

Just a FYI to WHOEVER claims title to these lizards, the boarding tab is still running. While it's true enough that a refund was sent to Tracey for her money that was wrongfully kept, these little lizards she got are still not what was advertised to her.


I am offering a deal that I will keep open for 24 hours: If Tracey can keep these little ole colorless lizards she was sent, we will forget the tab and call it even.

If whoever claims title to them wants them back, since they were not as advertised, they will have to prepay shipping, and pay the boarding tab.

Should this have to 'go further' the tab will keep running, those crickets and things are expensive.

24 hours. Serious. After that, if the lizards go anywhere, the boarding tab WILL be prepaid to Tracey.

And I am toying with the idea of filing for to get tab paid to compensate Tracey, so will the REAL OWNER please stand up so I can properly file? BTW, refund or not, the lizards were not what was advertised, so the DTPA is still applicable, I might could go for triple the boarding fees.......

Maybe it's just me, but I don't think they look ANYTHING alike...who knows, I was once told I didn't know what Apollo even looked like anymore!
