Repti-Racks: I re-read your first post and I have to say that you are 100% in the wrong here....Let me break it down for you in "simple" terms...
1. He bought the cage and waited a long time for it..
2. He got tired of waiting and decided to get something else.
3. So as to not be out a load of cash, he took a loss and sold the repti-racks cage to someone else to recoup some of his expense.
4. He explains this to you numerous times.
5. You use his explanation against him in order to seemingly refuse shipment.
6. The OP is understandably frustrated because you have his money and his customer is probably getting pissed too.
Bottom line: The OP originally purchased the cage from YOU....YOU should send the cage wherever he wants it because HE purchased it and he's correct, if it were fraudulent it would have been noticed quite some time ago.
My apologies for not thoroughly reading the initial post before commenting.....But, Repti-Racks is looking very suspect in this case which is only compounded by the numerous other bad posts out there about them. My recommendation is to contact your bank that the paypal drafted from and dispute the transaction. They are not authorized to turn you away due to time-frame like paypal can. Best of all, Repti-Racks has to prove that they send you the item...Scandalous business practices.....Also, glad to see you bought a Critter Condoz....They're awesome....sorry repti-racks is screwing you over but it's a pretty big club you belong too now.
You must have missed the part where the OP sold the cage to someone else, therefore, he is not entitled to a refund on a product he no longer owns.
Are you trying to say that even though he sold it to someone else he has a right as to what happens to it?
Was there a contract he signed with Nick saying he has a say it what happens to that rack? No.
Nick purchased the cage from the OP before the OP even received it. If anything, the OP is the one that looks suspect.
The OP's primary complaint included a solution of him getting the cage, refunding Nick and reselling it for more money. That is a poor business practice in and of itself.
Repti-Racks has no responsibility to let the OP know anything about the transaction anymore seeing as how he passed it off to someone else. The transaction is now between Nick and Repti-Racks. Without being able to get ahold of Nick, Repti-Racks has a right to hold onto the rack for shipment as that is the safe and responsible thing to do. As I said before, someone would have to be liable if the rack was delivered to an address someone was not at and it was then subsequently damaged or stolen. Since this would not fall on the OP, Repti-Racks chose the responsible thing and to wait until they gained confirmation of the address.
When you order caging, you are given "lead times" by everyone and everyone tells you that these times can vary. While I disagree with Repti-Racks not raising their lead times when they have had numerous issues on fulfilling their estimated lead times, you still agree to the fact it could be sooner or later. The OP knew this.
The OP is in the wrong for selling a rack he never had possession of and then thinking he still had some claim to it.
