I wasn't going to bother posting, because my opinion is the same as several others, Ben's a decent guy, never had an issue with Ben or any of his guys, and the OP shouldn't have expected TOS to be broken, shouldn't have expected a refund and to keep the animal, etc.
But she kept saying stuff about Ben not calling, if Ben had only called, etc. Then later, she admits that Ben DID try to call, and she simply didn't answer. Crying or not crying, she lied about Ben not trying to call her.
She posted a bunch of nonsense about how horrible the company was, despite not posting his name, she said she WOULD tell anyone who PMed her the name, so same difference. She was bashing someone publicly, when they were bending over backwards trying to make her happy.
I personally would never do business with her. I don't need to be handing over my hard-earned animals/product for free along with getting bashed while doing so.
And I've bought from Ben before(haven't won an auction yet) but I've never sold an animal to him. He declined to buy any of the animals I had available, yet he did so in such a polite and professional manner that there was no hint of hard feelings possible. Even when the tables have been extremely busy, if I waited until someone was free and got waited on as if I were a $10K customer. They've never acted like "know-it-alls" to me, in fact, I taught a couple of them about a reptile sexing thing at the table(even though I'm far from an expert at ANY species yet).
I would totally believe that Ben(or anyone else) can have a bad day, or have a button that might make him 'go off' a bit on something that he really despises. Seeing mites on available animals can make some keepers go nutso. Hearing about PETA/HSUS makes me crazy. Everyone seems to have a personal button. Doesn't make him a bad person, it makes him human.
To end... I don't think Ben is some reptile god, or the be-all/end-all of reptile selling. But he IS a great guy, he DOES have great animals, and he and his crew have always been really nice when I've stopped to chat or asked about any animals.
