So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Dennis has some very good advice. Remember this is also not a court of law. This is a court of opinion. Those who have a professional bearing, provide documentation to back up things that they say, and avoid calling people names automatically get the higher rating in the "court of opinion"... those who come in with both guns blazing, saying they shouldn't have to show proof, wanting everyone to believe that they were the injured party without giving any supporting evidence, and generally act LESS professional... well in the "court of opinion" they get a lower rating. I don't know the slightest thing about turtles and tortoises, I don't know anything about shell rot or expensive versus cheap animals of this kind. But I still read these threads, and I still form opinions based on attitudes first (since evidence is rarely presented from the beginning) and later on evidence.
 
I am in agreement with Dennis and Sasheena. I not dealt with either of you (I haven't heard of Will before), but from what I'm seeing, Justin is acting highly unprofessional. Name-calling, pointing fingers, etc. To be honest it seems like he is really upset because he is getting called out on something he did-almost like a temper tantrum. He really hasn't shown any hard proof to defend himself, except for calling Will a "Looser" (which really is spelled "loser"). Will however has provided photos, email, etc. I suggest that Justin compose himself and be more professional, because what I'm seeing is definitely not that.

Well I can understand you not keeping photos but I personally have hundreds of CD's burned and gigabytes of Pictures of animals I have had, sold, etc over the last 7 years. I do this for myself and no one else but if I need a picture all I have to do is go locate it. Now for your saying you should not have to prove yourself, well if you are in the right you should want to do everything you can to prove you are right and being wrongfully accused. By your attitude and name calling you are showing me more along the lines of the way a crook or person who has been caught doing what they are accused of. If you have the e-mails or any other proof that can prove you are being wrongfully accused then by all means post it.
 
uh oh, when these guys gang up on you its trouble, take it from me i know . just send him new torts, or take back the old ones and refund his money, you can always resell them, just this time everyone will know they have shell rot
 
I want to thank everyone for their support regarding this matter. The truth is that nothing I can do or say will be enough for Justin. No amount of pictures, emails, etc., etc., etc. will be good enough. If I post pictures he says they've been altered. The only altering I ever do is resizing to either accomodate them in my own computer or to fit the requirements of the Kingsnake photo gallery.
To address the notion that I should provide veterinary bills I have only to say that I am a physician and can and do perform all my own veterinary work. I can perform fecal flotation and blood testing on my animals as well as evaluate the presence of parasites that may exist. I have access to X-ray, surgical suites and all medications that I need through the institution I work at and like I mentioned before, I've been keeping turtles , tortoises snakes and other reptiles for 20 years. Long before there was good information available. The tortoises are alive right now. That is true and I've never said otherwise. They are alive not because they were happy and healthy before they came but because I've been acclimating wild caught animals for many years and I'm aware of the measures that need to be taken to ensure their health.
This is not a stable individual. Not a person capable of discussion without him resorting to accusations and name calling. I have provided proof of everything I've said here. Justin can deny what he knows is true like he has been doing but he knows that what I'm saying is true. The fact of the mattter is that this didn't have to come to this. My initial attempts at contacting him were never hostile nor accusatory. I had concerns about the animals that I received and I wanted to discuss those concerns. He NEVER responded. There really has to be a reason for that. Any responsible businessman should be able to answer questions about his product. Justin's girlfirend responded in the message I posted. I received the message from the account that I had received all of his responses from. She was speaking on his behalf. Plain and simple. Justin doesn't want to relinquish a dime regardless of the fact that he is wrong and knows it. He will continue to call me names, accuse me of "window shopping". Whatever. That's fine. The reality of the situation is that I'm a serious turtle/tortoise keeper and breeder who prefers to remain anonymous. Situations like this remind me of why I stay away from these communities. Thanks again to all of those who have posted on my behalf on this forum as well as to those who have contacted me privately. Justin has clearly signed off without claiming any responsibility nor ever having the common decency or courage to contact me personally. So, this is me signing off as well. Tortoises

I have pirchased many high-end chelonians from Justin Mitcham without any problems. I believe that this problem was not intentional. With the mere volume of specimens that Justin must have, problems can and do arise....human error occurs every day in our lives....most oftentimes unintentionally. I have never met Justin but I do trust his judgement....I have yet to receive a inferior specimen from him. I am very happy that Dr. Ahrens and Justin have reached an positive agreement...life is short--it is easier to be fair and honest--especially in the brotherhood of herpetoculturists. The BOI is truly an asset to the community as it aids individuals in their choice of dealing with people who will or will not deliver what a customers has purchased !!!!:D

Justin Mitcham is a horrible business man

To make a long story short I purchased two Pastel RES for Justin. He guaranteed them for a week. I ended up taking them to the vet in less then a week. They were not eating and the had URI. They died in less then a week. They were very tiny. I contacted him via phone and email, he hung up on me. I found a reputable turtle dealer on the internet (TurtlePimp) he has also tried to get in contact with him, no answer. I feel he has ripped my off-Please be aware of this turtle dealer!

She bought two and I sent 5 TOTAL due to the fact I had some extras with nubbed tails..
This happened several months ago...
This person emailed me that they arrived, and all were in excellant condition, praised me for how nice and healthy they were and was thrilled to have the extras , then two days later said all 5 had died on the same day, and wanted her $$ back. Another friend of mine bought the entire remainder of the pastels, over 20 and not one had a problem and he can even post that fact on here. This PERSON has bought over a 100 pastels from me and wants all that I come across again this year...Now thats a satisfied customer.
I told her that 5 baby turtles do not arrive in perfect shape then turn up dead two days later and that I wasn't going to cover human error on her word alone, I guarenteed health and feeding for one week but not obvious human error and not without 1st answering questions or providing proof of which i never recieved.So i got tired of her bothering me and I did hang up on her.I can understand them not eating and sending them back, I can understand saying that there sick or seem i'll, I can understand one dying unexpectedly,but not one day 5 alive then 5 dead no inbetween, especially when they picked out there OWN turtles from over two dozen animals out of which I havn't lost a single animal, nor the buyer of the remainding 20 or so.It's odd that they failed to mention that all 5 died on the same
day, and that I gave them 3 extras, probally due to the fact that it would draw obvious concern to her method of care and would raise eyebrows to the fact they all died at once. Sounds better with pieces of the truth missing. I can go through my shipping records and find the AWB that shows that a total of 5 were shipped, I always label quanities and species for leagal purposes.
So 5 turtles die in the same day ,that were perfect the day before even by her own admission...Sorry that stinks and I am not buying it. Also I would like to see a vet. report posted here since the email I recieved only stated that they had died , not the fact that they had seen a vet and were then subsequently diagnosed, then all 5 dead the next day.
So what is it... did only 2 out of the 5 die..so do you still have the other 3?? Doesn't the fact that I sent extras count!!
Or did all 5 die like you told me in the begginning, just didn't want people on here to know that all had been struck down by a UPPER RESPITORY infection in a 24hr. period. Never seen a UPPER respitory do that is 24hrs. sure it wasn't ebola or somthing!!!
Upper respitories are usually quite slow to kill and debilitate
over a extended period. If they had URI you would know it on arrival.They would of had severly swollen eyes a runny nose etc...she wouldn't of told me that they were fine etc.. they wouldn't even been presentable in the pics I sent her. Turtles with URI stick out like a sore thumbs and is perhaps the easiest to diagnose externally.
As for TurtlePimP I do not recall him emailing me or contacting me on there behalf and if he did I'd tell him what i stated here and if he didn't like it then there was nothing I can do for him or these people.

The vendor had a guarantee listed on the website for the Pastels that the turtles are Live, Healthy, Happy Arrival Guaranteed. Each animal comes with a one week health and feeding guarantee. I contacted Justin Mitcham the owner of the company. I inquired about the price, shipment and guarantee, for two Pastel Red Ear Sliders and shipping. Justin told me the turtles would cost $125.00 included was shipping. I paid him immediately through my paypal account with credit card. He then shipped the turtles to me with five extra 3 pastels with deformities and two red bellies. The turtles did arrive the next day February 5th. I contacted Justin to let him know that I received the turtles they seemed to be OK. I brought them home put them in a proper aquarium at the appropriate temperature and tried feeding them, none of them seemed to want to eat. I tried numerous foods over the next two days. I contacted Justin I told him they weren't eating and that they looked sick. He told me that they need sometime to adjust, he told me the temperature of the tank should be 75-80 degrees and told me to try feeding them worms. I emailed Justin back I explained to him that my temp in the tank is between 75 and 80 degrees and I will try the worms. I also told him that I have experience with turtles, and that I do have other ones. He told me to keep him posted. Monday the 9th I emailed Justin and told him four of the turtles died. Tamara wrote me an email back stating that Justin was out of the office he will get back to me on Wednesday the 11. Tuesday the 10 I emailed him again, thanking Tamara for letting me know about Justin. I also told her that another turtle died. Now that 5 out of 7 turtles died, I noticed that the other two turtles were sneezing, yawning and also not eating. This is a very common symptoms with turtles that have pneumonia or Upper Respiratory Diseases. I took these two turtles to the Vet to have them looked at. The doctor prescribed an antibiotic injection (Baytril) daily for these two turtles. I finally got the turtles to eat and it looks like they are getting better. Justin finally contacted me via email on Thurs February 12th He told me there is no way the turtles could have died that it is my error. Also, that I need to send pictures of the aquarium and dead turtles, then he might consider a refund. I have repeatedly sent emails and phone calls with no response because I have no address to send the pictures to. I have been repeatedly hung up on when I call Justin after being asked who is calling him. I have even wrote to him just asking for the two Pastel Red Ear Sliders to be replaced. I have received no response. Justin advertises on his website with the guarantee that the turtles come with a one week health and feeding guarantee.
