I did not mean that it was only Ken on the shipping.

Could Bobby have checked the weather, YES. What I am saying is like a back up plan thing. You know, Ken saying " Hey Bobby I bet you already know but it gets real hot here! Maybe throw in a couple cool packs and make sure the label says keep at room temp"

Not that it was his responsibility! I think you guys took it wrong. In winter time I always make sure I tell the shipper " hey it is cold make sure the hot packs are in there." Just as a reminder type thing.


I think both parties were not in the deal enough. They took for granted things maybe they should not have. Bobby thinking the animals would be fine the way he has packed before and Ken thinking Bobby would pack the way he does. More comunication during this deal might have saved the snakes lives.

I am not saying Ken is a bad guy or that Bobby is. I think Ken has posted very level headed! And I really respect that, and the people that really have nothing to do with this are going off.

Well my 2 cents that may only be worth 1 lol

Oh and to add I have not dealt with either party. I am just looking at this at every angle. I am not the judge and jury. Ken and Bobby are the only ones that can settle this.
 
Just to clear up one thing...

This was a trade that Bobby approached Ken about.

Bobby shipped first.

Bobby's animals were improperly packaged and died.

Bobby thinks that Ken still owes him the animals that would have been sent had Bobby known how to box and ship a snake.

Right now, Ken is not out anything- with the possible exception of having a seriously misnamed thread written.
 
Maybe your both in the wrong.

I don't know either of these guys so I am not leaning on one side. If you think about it he was in the wrong for not being there when they first tried to deliver them. But needless to say the temps where way to high to send them door to door. Did you use the by noon service or before 10am? The Airline's are only like $40 more I don't see why more people don't use them instead.

Didn't somewhere back there in the first few pages Ken mention that he was not expecting any snakes from bobby the day they were delivered? Sorry if I mixed it up but I didn't want to read through all 11 pages to see if that's what I actually read or am just thinking I did, because if that is the case then Ken is totally out of the picture as far as blame goes. In fact since bobby had to know where he was sending the snakes was Ken's business then he had to know there would not be anyone in early and should have put a number on the box to call in case there was no one there to recieve the snakes. But then he should also have marked the box as having live reptiles in it and that's been gone over enough.

I can swim in the summer at 2 am and when I get out and dry off.... fifteen minutes later I am wet again. This time from sweat.

Looks to me like everyone can develop their own opinion, but both Bobby & Ken have stopped posting.

Hopefully, they've exchanged some emails and/or phone calls, resolved the situation, and gone on.

I hate that the title of this thread can't be altered, because I think it was probably typed during an emotional time, which made it inaccurate.

However, the horse is dead, let's stop beating it.

There were lots of lessons to be learned from this situation. Hopefully, some animals that might have suffered the same fate will be spared because more attention will be paid to packaging and communication.
 
I think alot of you are missing a major point.

Regardless of Ken missing the first delivery attempt, those snakes were most likely dead already because (as Seamus states) of either negligent or ignorant shipping methods. According to the weather page that John gave us the link to: the weather in Vegas tomorrow will be 92F at 9 am.

If the weather was the same when Ken recieved the shipment (IF-although temps all week seem to be consistent), regardless of whether or not he was there....I can almost guarantee that 2 small snakes in plastic containers and NO INSULATION would be dead by the time the ambient temps reach 90F. Not to mention the fact that the point of departure almost 24 hours prior was only near 70. Talk about thermo-shock.

When dealing with live animals, SHIPPING is EVERYTHING. Not only because we have an ethical responsibility to these animals but because what good is a sale without the merchandise?

Even the airlines (who tend to know squat about herps) have made a styrofoma-lined cardboard box the minimum requirement for shipping live herps. If a dealer hasn't learned that in 13 years then it's time to find aother dealer.

He should have been there to find out. Its not Bobby's responsibility to hold his hand at the door.
 
Just to clarify...

My point in the last post is just trying to illustrate that when you guys order herps from someone...make sure they know what they are doing. If someone has shown on multiple occasions that they cannot properly package an animal for transport in order to assure the optimal health, then that's someone who you should stay away from.

So what if his store doesnt open until 9am, should of had it sent to his home.

I don't think that this has ever been the case...it's the majority's concensus that you are to blame... In fact, even though not at fault here Ken is still offering to work something out even though you posted a misleading thread before he could respond to you privately.

That speaks friggin' volumes.

Not to make a mute point out of it but why would you send a box of live animals out that you know could have been packed better? I do commend you for admittimg it though....that takes some guts! I still think the cost should be split!
 
Indeed, complete blame does not lie with you, Bobby. However, a significant portion does. IMO, you and Ken both share culpability for this event.

Ken had a responsibility to be there to sign for the package when it was delivered, and you had a responsibility to package the snakes properly. Both of you dropped the ball.

Just as you should not be held responsible for Ken not being there to sign for the package, he should not be held responsible for the inadequate packing. Styrofoam and cold packs are a must when shipping to someplace like Vegas in the summer.

Let's use tomorrow's temperaturs as a hypothetical example... The snakes were sent Priority overnight, which guarantees delivery to most locations by 10:30am. Well, by that time, the ambient temperature in Vegas is forecast to be just over 100 degrees. That means that any packages delivered will be sitting in the back of a delivery truck in the morning, while the temperatures are rising from the upper eighties, through the nineties, and approaching 100. In should also be borne in mind that it's not uncommon for drivers to be behind schedule and for packages to be delivered late. A little foresight goes a long way when it comes to packing.

That being said, I'd like to touch on one point that others have made- whether proper labeling would have affected how the package was handled by FedEx. Assuming that they didn't refuse to ship it, it's highly unlikely that the box would have been handled any differently.

According to this website, on July 8th, it barely dropped below eighty for the entire day...

In his own first post he also has Fed Ex's tracking which says the package arrived at Fed Ex's ramp at 8:45 AM... I think that means his "It wasn't picked up till 5:30" is an outright lie...

So that package was sitting in the back of a fed ex van on a nearly ninety degree day, all day, before even starting the trip to Vegas.

While it's been said before and didn't really need to be explored all that much more in detail, this is just another example of Bobby's misconduct, he has lied to the entire BOI about the temps the day of shipping.

You beat me! This thread has gone to page 12, and someone still think Ken should split the cost; if Ken was there at 8:45 a.m. to receive the package, the snake may be alive, etc.... Well, indeed, if you click on this link (also the same link that Seamus provided), and do the test that I offered on page 10:

These two poor snake had been travel in a Fedex truck a whole day with temperature fluctuation that get as high as 80F degree (instead of 60-70 like Bobby claim) with no mean of insulator. I would think they were already dead before they left Cleveland, Ohio. Even if Ken was at his store at 8:45 a.m., what he received are two sauna (sp?) with two steaming snakes. What an ignorance Bobby is!!!
 
I know we are shooting a dead horse but OH well.

I know that at 8:45 it was at 85 deg. at Kens door. Now could he have sent it to Kens house,sure then it would have came after Ken had already went to the shop.

If someone ships to me and pays the extra money for morn delivery, then they lost 10 bucks, I know that here I get one try and all 3 shippers come between 1:30 and 3:00. The only thing I tell people when shipping to me is what the temp is at that time. I see snakes shipped all over and they do just fine. I also lived in Phoenix for five yrs and never had a problem shipping to or from there. Hot or cold packs. It is real simple. Bobby is in the wrong for his packing and shipping errors. Ken is not out anything but a customer and one really long thread that is misnamed.
The worst part is that Ken lost a chance at snakes that he really wanted and because of somebody not giving a damn about the animals they shipped, he lost the chance at having those animals.
I guess its time to let this die.

Well, I guess we have all come full circle with this one, more then once I think. This is most likely the last time I will post a reply on this subject (but no promises!). I have some thoughts about what has transpired between Bobby and myself, and on some of the opinions raised by my peers on this thread. Some will agree with my conclusions about this whole ordeal, some will not. I do my best to make everyone happy, but alas, I learned long ago that it's just not possible. But I keep trying anyway. Pie in the sky and all that.

First and foremost, I would like to thank everyone who has expressed their opinions on this thread. You may or may not agree with my final conclusions that I'm about to type, but thanks for the interest just the same. I would also like to thank some of my good friends that have posted here on my behalf, and all my customers that were kind enough to post also. I do value all my friends and customers, past, present, and future. I read this forum almost every day, and have come to respect and admire many of you that take the time to post on important issues.

Ok, here are my thoughts on all of this that has led me to my descision. First and foremost is the packing of the animals. It was shoddy, unproffesional, and fatal. It is obvious to anyone that Las Vegas is one of the hottest places in the country in the summer, that is a no brainer. To send those snakes into this place in that box was wrong, period. It does not matter when they got delivered. If packaged correctly, they would have survived. How can I make such a statement? Because I do it almost every single day! Today it was over 120 degrees at my store location. Nevermind the official temperature at the airport, it is always about 10-15 degrees hotter here in town because of all the cement that radiates the heat. Yesterday was just as hot. Yesterday I sent out 2 Day Geckos, one Ground Boa, one Baby Greek Tortoise, some box turtles, and a 16 ft tiger retic. I have gotten calls or emails from all of the customers these were sent to, all were AOK at the recieving end. I do this almost every single day. For some to suggest that I am neglegent to ship when the weather is hot, let me remind you that I live in Las Vegas. It's over 100 degrees here almost 6 months out of the year. I have a business that I need to run that depends on me being able to ship animals in and out of this city year round. To suggest that I suspend my business for half the year is just not logical. Instead, I make sure that every shipment I send out is well packed, protected from the heat in the summer, and the cold in the winter (as it does get darn cold here too). I can honestly say that in all my years in business, I have lost a total of 3 animals during shipping. I know that even one loss is tragic, but my track record on this in my opinion is not all that bad. And on all three of these animals, I replaced them without hesitation. I'm the shipper, I'm the proffesional that is collecting the money, I'm the one responsible.

Now, to the fact that I was not here well before my posted hours of operation, both on my door, in all my ads, and on my website, I can only give you this reply, as candidly as I possibly can. I do not live in my store. I have other places to be, other things to do, and other people that depend on me. Some have suggested that I be at the store all day long if I'm expecting a live animal shipment. What time frame is being suggested? Should I be there at 7am? Stay until midnight? Or, just in case, should I get up and be at my door at 5am? Can I borrow a cott? Please, I consider myself to be a somewhat reasonable person, but to expect me to be at my store up to 18 hours a day just in case I am going to miss a package is just crazy. My hours of operation are posted. My vendors know what time I am open. So do the delivery personel that bring me my goods. So did the Fedex delivery driver. So does Airborne. Delta does not even bother calling me until after 9am. I don't open until 10am, but the guys at Delta all know me and when I come to work. There is always someone at my store, preparing for the workday at 9am, always. Now, on the other hand, if the driver had been aware of what was in the box, it is easy enough for him to pull out the handy dandy fedex cell phone and call me. Plain and simple. Me not being there at 8:48 is nothing to blame me for. I am never there at 8:48, unless I am aware that I am needed at that time. I was never given any notice that a live animal would arrive that early in the morning. It has never happened before. I was not there. If I was there, would it have made a difference? My conclusion is no. It was over 90 degrees by then. The truck left the ramp at 7am. I talked to the driver, I know the route he took. He attempted delivery at 8:48 am. That is a travel time of one hour and fortyeight minutes in the back of a metal van, with no insulation, no cooling devices, no chance at all. Can I prove that they were dead at 8:48? No. But, in my experience living in this heat, and working with herps for over 30 years, I believe that they were. My opinion is pretty set on this one, and I'm not likely to budge on it.

I have contacted Bobby to try to resolve this issue with him. I offered what I thought was a fair deal to make him happy. I did not have to do this, since I don't believe I am to blame for any of this, but I did it anyway, just out of good will. I believe he rejected my offer, although his response was somewhat cryptic, but I think he said no. I then asked him to propose something of his own. It has been over 24 hours since I emailed him. His website states that he responds to ALL emails within 24 hours. I guess he is not going to send me a return email with any suggestions. Considering that he waited a total of 5 minutes for me to reply to his first email before coming to the BOI and shouting to the world what a bad guy I am, I feel that 24 hours is more then enough time for me to give him in return.

This attempted transaction with Bobby will of course be my last attempted transaction. I am not bitter, and I have nothing personal against the man. I don't like being called "BAD", but then again, who does? All through this whole thing, I have read every post, I have listened to all comments. However, I have never been one to be swayed by public opinion, and this deal is between Bobby and myself. I have always been man enough to admit when I'm wrong, and I have always stood my ground when I thought I was right. I think I am right now. I did not pack the box in a shoddy way. I did not contract with a carrier that has no aircondition vehicles to deliver live ectotherms in oppressive heat. I did not neglect to inform the carrier of what was in the box. I did not neglect to label the box as perishable. I did not neglect to ensure that the animals be delivered during posted operating hours. I did not run to this forum screaming "Bobby Pruit: Snake Killer" in a matter of 5 minutes after contacting him. I do not owe him anything. I did, in my first email to him, ask how he would like me to verify the deaths. I offered to send him a photo, or freeze the bodies and mail them back to him (properly packaged to keep them from thawing, of course). He never responded to my question, except on this forum. It was a somewhat nasty statement, making it look like I never asked him how he wanted verification. My question is in his very first post, please note that there was no reply. However, since I'm here anyway, I will post the pictures here and now.

In conclusion (once again, I'm sorry this is so long), I'm pretty much done. I gave Bobby an offer that was turned down. There will be no more offers forthcoming. I'm sure my decision will not please everyone, but that just can't be helped. It is my decision, and any consequences that come with it will have to just be lived with. If this makes me a bad guy, I'm sorry. If this makes some of you not want to do business with me, that is my loss, and I regret it a great deal. My customers ultimately become my friends.

I think the owner and shipper has a right to see proof of the animals in question, Pics. In fact if I have a loss, the first email out has pics of the animals. Kens email said " they're dead but thanks for trying" Ken, Terms are on many dealers websites stating if your not there to receive delivery, no guarantee. We will never know if they would have made it at 8:45. All this speculation is beside the point now. Danny Mendez, why don't you and Bobby meet somewhere and work this problem out between yourselves? I just shipped 20 red eyes in the other day, got here at 12:30 in 90 degree temps without cold packs. Didn't lose a one. We have no idea what happened and all this speculation is just kids picking sides in a playground fight. Like I said before Split the Loss guys and move on . Ken, I for one will never ship you anything. You have contacted me about my Leachianus. Your laid back approach to receiving animals is wrong. I put too much work into producing my animals, just to have someone make a comment like ( they came before I was ready ). Someone asked in a previous message if Ken knew they were coming. He Did and had a tracking#also. It was a before 10:00 am service, so he should have known to watch or call the hub and have them hold the package. The receiver has responsabilities in a transaction also.
