I guess I am on the Chris blacklist I mean, for requesting a refund? Below are the e-mails that went back and forth for nearly six months. Sucks big time! I hate acting as a collection agent for myself and it seems that every year I find myself having to do it more and more! I don't know which is worse getting nothing or getting a pair of severely sick Ball Pythons. I already received, through a purchase, my share of sick Ball Pythons for this year and I do not want to do that again. Doesn't New York State have one of the toughest animal police departments in the US? And, can not the FBI internet fraud department help a little in situations like these? Funny thing is that I ordered five Ball Pythons this winter from two different states around New York while the weather was in the 30's and I received them without a single problem, including any health problems. I also talked with several people upstate who breed Ball Pythons for a living and they said they ship during winter as well with no problems. Another thing that is odd is that anyone I have talked to that say they know Chris, have said that they were not aware that TSE breeds their own Ball Pythons, and as far as they knew TSE buys wholesale only, not breed their own.

I placed a order with you on November the 14th 2005 for a 1.1 pair of baby ball pythons that are 100 percent Het. for high contrast albino. I received the automated order confirmation and I did answer all the questions and sent it back as requested. I also read all the TOS on the Top Shelf Exotics website so I am fully aware about the weather notice. I understand that weather is a great concern in shipping live animals and I would rather wait until weather permits. So, this is not a issue to me. However, I do have a couple of questions that I would like answered that I can not find on the website. This is my third time at contacting TSE sales department. This time I used a different e-mail address.
1. What temperatures are expectable for baby ball pythons to be shipped? Our Low for Wednesday, January 18th 2006, is suppose to be 50 degrees.
2. If I placed an order with you for a 1.1 pair of baby ball pythons back in November 2005 are those the same 1.1 2005 baby ball pythons that will be shipped to me sometime this year?

Also, the form I was expected to fill out that was sent to me by you after I made this purchase in 11/14/2005 was sent to you filled out twice since. I have received five ball pythons last month from people in two different states who are located close to New York State without any problems. Do you feel that this week might be the week that I will receive my purchase? If not, please give me an estimated date of when I should expect to receive my ball pythons. If you are finding a date to ship my purchase to me a harder than usual task for you then please send me back a refund and I will make arrangements to purchase a pair of albinos, or 100 percent het for albino, from another merchant. I understand the feeling of always being rushed with orders that are backlogged. I also understand that you have no choice but to ship in the order in which the orders were placed. So, if you will, please answer a few questions for me while I wait for my purchase.
1) what is the number of packages being shipped out per week?
2) what number am I in your backlogged list of customer shipments that can be shipped?
3) is my order of the 100 percent 1.1 albino hets guaranteed as being just that - 100% het for albino?
4) are my 1.1 guaranteed to be a 1.1 male to female ratio?
5) are my snakes cb where poss. one parent is a wild caught female breed to a cd or cbb albino male or visa versa, or other explanation?
6) Or, are they cbb where maybe they are from two cb parents, or one parent that is cb and the other cbb, or both parents are cbb?
7) will there be a 100 percent guarantee that they are either cb or cbb?
8) will both of my snakes be guaranteed 100 percent healthy and feeding on frozen thawed?
9) Will you thoroughly inspect my snakes before they leave the facility for any imperfections such as an infections and etc.?
10) under what circumstances will a refund be issued back to a customer of yours?
11) who was it that took my order and will be filling it? First and last name please. I thought that it was Chris that took mine and all of the orders but from what I understand Chris has not been there since my order was placed back in November.
I understand that these might seem like a lot of questions under the already mounting pressures you are experiencing but please do find time to answer them for me. I really would appreciate it very much and it would seriously ease my nerves after reading all that I have on the BOI today, but then again my nerves were on edge before that thread was started. I would imagine that yours are too and for that I am sorry. However, some of the things that are now being brought up on that thread has me really on edge, so rather than asking my questions there and only get speculation on them I decided to ask you, after all, you would be the one to know. Hope everything is alright and that I get my snakes soon, but then again you could hold them for me until they are of breeding weight and have produced their first baby albino for me. LOL!

I have yet received any response from you. I sent you an e-mail Friday asking you some questions for reassurance and I felt that surly I would hear from you today. Well, I am tired of waiting now so please send me a full refund. I can easily find a merchant that will not only address my concerns in a timely manner but will not have the hang-ups or problems with shipping that you are apparently experiencing right now. Nearly six months is way too long to wait for something that I did not specially order from you or plan on. The fact of the matter is that if I had known at the time of my order that there would be this much time passing, and still no purchase shipped to me, I would of never made that purchase from you - honestly. Your ad at that time did not mention that I should read your TOS before making my purchase, nor did it make any suggestions or hints to read the TOS for any reason, and in fact, the guarantees were in the ad, Plus I was buying based on reputation too, so I did not feel that I needed to read the TOS. It was not until It was nearly a week after the purchase that I read your TOS on your website and I read about the winter weather notice. So, I was more than agreeable to wait until weather conditions improved (in spite that I know of a reptile and Ball Python breeder in Wisconsin that shipped all through this winter with no problems) and when the weather did improve for you and me, I was again more than agreeable to wait some more while you caught up on your backorders. However, enough is enough and I am simply too tired now of waiting so please consider this e-mail my formal request for a full refund of the money I send to you almost six months ago. Withholding my refund, in spite of what is said in your TOS about refunds, in fact, goes against not only your own TOS, but it also goes against the TOS of Paypal when you signed up with them as a merchant. I am very sorry that my patients are no longer as thick or forgiving as they were in the beginning of this and I hope you understand my decision and that you will not hold any prejudice against me. I do wish you all well and I hope that you and Chris get through your problems and that you will be up and running smoothly again very soon.
