Maybe these were considered by you, possibly discussed with Wendy, etc., but I see no mention of such in this thread. For future reference, here is what I do to address conflicts in choice of shippers.

1) As mentioned earlier, my local DHL is poor. When a customer insists on it, I take the package to an authorized DHL pick-up store. Easy to find on-line. I put the pre-paid label on it, and it costs me nothing except the effort to get it to the store.

2) Where UPS delivery is a problem on the receivers end, whether because the client is "far out", or the UPS driver careless, or in cases such as summer deliveries to Vegas, Phoenix, etc, where time-on-truck is so deadly, I just ship to the nearest UPS Service Center as a "Hold for Pickup". Its probably the safest thing for the animals. Works like a charm, and easy.

As they say, "an ounce of prevention is worth a pound of cure".

youre right, and from what i see, if anyone knows geckos they dont look like theyre 7 grams even from the pictures. but all look healthy to me.

Nor would I buy any under 4 grams.

Just like you would never accept anything being shipped by UPS, even though Erik quoted your e-mail where you acknowledged and accepted that they would be shipped by UPS, even stating how many times the UPS guy has dropped off the package and run over the last 2 years, even though you NEVER accept shipments via UPS...

He told me they ALL weighed 7 grams and could be housed in the same screen cage.

No doubt this is in the e-mails that you have failed to provide to back up your claims, even though you said you were going to post them, yet another hint at your credibility, or lack thereof...

This is now between him and Jeane. The payee. I highly doubt she will EVER come here. Unlike me, she doesnt care what the community thinks.......I should take notes. Case closed. I made my point!

How convenient, I guess the only thing left now is to wait for the threats of legal action. You have been studying the "handbook". When will they learn that the "handbook" never works?

Yall lost me in a few of the questions. The driver did see that one was dead as I told erik when I called him within 5 min of me getting home. I never told him I waited to open the box here. he has misunderstood something I said. I opened them at the roadside. She had to loan me a exacto thing because there was too much tape to get into it with a key. I took a fully arranged large cricket type plastic carriers (X4) with me complete with food and a misting bottle.

Ok, then please answer this one question. How can both statements be true? You stated, you were sitting at the truck for an hour. You get home (2:00pm), to see that. Meaning the DOA. If you opened the package with the UPS driver, How did you not see the DOA until 2:00?

I had to drive 32 miles to meet the truck and the driver had me sitting there an hour. Get home (2:00pm) to see that

Curious as to how many times someone has to curse before it becomes a deal-breaker to trying to work things out, or at least allow for some cool-off time ? 1 ? 3 ? 5 ? All you can fit in 24 hours ? Virgin ears are a difficult burden to bear. No cooler-heads prevailing here.

Dennis, I see the inconsistencies with determining when the box was actually openned, although I have no reason to believe that there was not a dead gecko in the box. The extended time on a hot truck could have caused heat trauma to all, and caused a second death? It would explain the deaths due to the deliberate negligence of no one, just a lack of diligence. Erik's TOS covers his being not responsible. In hindsight, I would hope that both parties see a better way to proceed in the future.

There hopefully is more info to fill in the details, if necessary. But the first response by Wendy seems to be that she is replying to the fact that she has been notified that the animals are on their way via UPS, after already providing her DHL account info (I think). So she has already "bought", although I guess she could have refused delivery? The first statment is consistent with the second if in the context that Wendy was referring to the time of purchase, not when she was notified of the means of shipping. Possibly the miscommunication was all hers to bear, and maybe not, but that she has doubts about UPS before the animals ever arrived seems well established, and not inconsistent that she tries to avoid them (which may be a more accurate statement about her true workings with UPS ... agreed).

I would also wonder why she would spend a couple of hours sending pictures last night to Stephanie and not provide the emails that would show that she in fact had an agreement from Erik to not ship UPS as she first stated.

However, the last quote on the subject she made has now changed again. Wendy earlier stated that they had an "agreement" but now she is stating that she merely asked him not to use UPS. Not that he agreed.

I have yet to see any geckos posted for sale anywhere including Sarah site, Pangea, AC, Clark,crested Gecko.com, Ect. I think that sets a standard. That weight less than 4 grams for sale.

Anthony (ACReptiles.com) has some on his available page right now that are 2 weeks old. He doesn't list their weight though.

All true regards to inconsistencies. But I still see ample room for miscommunications here. Maybe its confirmed earlier in the thread, but I don't know that Erik acknowledges that there was at least talk of DHL, either in a phone-con or email. If he even was in receipt of Wendy's DHL account info (IF ?), then I hold him partly accountable for the screw-up. As to just where in the process he should have seen the opportunity to do something better, such as discuss it further with Wendy, we may never know at this point. Messes such as this, and in life, usually get out of hand when two things go wrong. There is an obvious miscommunication over UPS being the settled shipper prior to shipping, and then we have the missed delivery that likely contributed negatively to the health of the animals.

Just as an aside. I spent 15 years in restaurants, eventually owning several. If I took every customer that went over the top with a complaint, exagerated (in my mind) how bad the food was, or how rude the waiter was, or just got all discombobulated, and decided to show them the door ....... I'd have only been in restaurants for one year.

Kelli, is it a difference in that the individual you mention at least specifies the age, so as to avoid confusion? I haven't seen Erik's ad, but was he as specific in creating a proper expectation, or was there room for a misunderstanding, or an errant assumption ?

Jim, I do not know if there was ever a mention of how old Erik's geckos were. Maybe Wendy can post the email communication she has, perhaps it is in there. I was only pointing out that at least one of the crested gecko breeders she pointed out sells two week old hatchlings. I can tell by looking at the cresteds Erik sent Wendy that those are more than 2 weeks old.

A few of those in the thread which deals more with this have heard the threatening phone calls made by "men" to "women". I have also seen the "men" to "women" phone records and emails. Your claims do not currently have such evidence, although one of the threatened "women" provided the contact info for the Officer in NY who spoke to you. I do not doubt that harsh words went back and forth. Sorry ladies, but when a woman says she's going to "kick my ass", I get an anticipatory smile ! I guess all that makes me just a tad sexist !

Kelli, sorry to attach this note here with the debris. Thanks for the info. I do fault the person who makes a wrong assumption as being the primary person responsible. I also admire those breeders/suppliers in the business who overcommunicate, anticipating the potential for wrong assumptions, and minimzing them. They are out there, and usually quite successful.

According to this, from the first post on this thread, Wendy says "no problem. Sounds Good" in regards to Erik using UPS. This is 4 days before they are shipped, so the whole "UPS was forced upon her" theory doesn't hold water.

Also, Erik stated earlier that she never said anything about her offering him her DHL account to ship with, I guess that part must also be in the e-mails that she has yet to provide.......

As a side note, did DHL change their policy to now allow shipping reptiles? Or does she just ship reptiles regardless of carrier policy?
